سیاست‌گذاری‌های جناییِ کارآمدِ بین‌المللی و داخلی در جهت تضمین امنیت غذایی

استقرار، پایداری و امنیت غذایی به‌عنوان حق دسترسی بشر به غذای کافی، ایمن و مغذی با حقوق محیط زیست ارتباط مستقیمی دارد. در حوزه‌‌ی امنیت غذایی و حق بر غذا، جرایم زیادی اعم از جرایم حوزه‌‌ی مواد غذایی و جرایم حوزه‌‌ی زیست‌‌محیطی اتفاق می‌افتد که امنیت غذایی و در نهایت سلامت شهروندان را به خطر می‌اندازد. در این میان، کشورهای توسعه‌‌یافته برای جلوگیری از این جرایم، تمایل به سیاست‌‌گذاری‌‌های افتراقی و تخصصی در حوزه‌‌ی پیش‌‌جنایی، جنایی و پساجنایی دارند که هدف این پژوهش، شناسایی موارد ذکر شده است. این تحقیق از نوع نظری بوده و روش تحقیق به‌‌صورت توصیفی تحلیلی است، روش جمع‌آوری اطلاعات نیز به‌‌صورت کتابخانه‌ای است که با مراجعه به اسناد، کتب و مقالات صورت گرفته است. در حوزه‌‌ی تضمین و حمایت از حق بر تغذیه و تامین امنیت غذایی از رهگذر سیاست‌‌گذاریِ جنایی شاهد پیشرفت‌‌هایی هستیم، اما در این حوزه افتراقی‌‌سازی در قوانین کیفری دیده نمی‌شود. نظام حقوقی ایران بهتر است برای سیاست‌‌گذاریِ جنایی پیشگیرانه و واکنشی سنجیده در این حوزه، منشور جامع سلامت را تصویب کرده و سیاست‌‌گذاری‌‌های کلان‌‌تری را طرح نماید تا قوانین موجود بر آن اساس اصلاح گردند؛ چنانکه، در این پژوهش به بررسی این موارد پرداخته می‌‌شود.

effective international and domestic criminal policies to ensure food security

the establishment and sustainability of food security, as the right of human access to sufficient, safe and nutritious food, is directly related to environmental rights. in the field of food security and the right to food, many crimes occur, including food crimes and environmental crimes, which endanger food security and ultimately the health of citizens. in the meantime, developed countries tend to have differentiated and specialized policies in the pre-criminal, criminal and post-criminal fields to prevent these crimes. the aim of this research is to identify the mentioned cases. this research is of a theoretical nature and the research method is descriptive-analytical and the method of collecting information is library-based and has been carried out by referring to documents, books and articles. we are witnessing some progress in the field of ensuring and protecting the right to nutrition and ensuring food security through criminal policy, but differentiation in this area is not seen in criminal laws. the iranian legal system should adopt a comprehensive health charter for preventive and responsive criminal policy in this area and propose broader policies so that existing laws can be amended accordingly. this study examines these issues.
