Abstract
freedom of belief and freedom of expression constitute two of the most fundamental natural and social rights of human beings—rights that underpin the establishment of democratic order, political participation, and the cultural development of societies. within both the intellectual heritage of humankind and islamic teachings, these rights embody the manifestation of human dignity and rationality. pursuant to article 19 of the universal declaration of human rights (1948), the international covenant on civil and political rights (1966), and the cairo declaration on human rights in islam (1990), freedom of thought and expression are recognized as essential pillars of social life, subject only to limitations grounded in public interest and morality.this study, employing an analytical-descriptive approach and drawing upon both domestic and international library-based sources, examines the relationship between freedom of belief and freedom of expression within the legal framework of the islamic republic of iran. the analysis reveals that, although the foundations of islamic jurisprudence and philosophy acknowledge human dignity and freedom of belief, in practice, considerations of national security, cultural preservation, and the protection of religious values have imposed significant constraints on the exercise of these freedoms.findings indicate that expansive interpretations of concepts such as “public interest” and “preservation of religious order” sometimes diverge from the spirit of human dignity and the principle of free will. consequently, a rational and dialogical reinterpretation of religious and constitutional norms—grounded in the philosophy of dialogue and the principles of international human rights law—may pave the way for a more authentic realization of civil liberties within the islamic republic of iran. such freedom is not in opposition to faith, but rather constitutes a precondition for human dynamism and moral responsibility.
