کارآمدی نظام اجرای احکام مالی: بررسی با نقد موردی روند اجرای یک رای

این پژوهش با هدف ارزیابی کارآمدی نظام اجرای احکام مالی در ایران و شناسایی موانع و چالش‌های موجود در این فرایند، به‌صورت توصیفی-تحلیلی، با بررسی دقیق یک پرونده قضایی واقعی، به‌ نقد اجراییه صادره از دادگاه و مراحل اجرای حکم پرداخته است. داده‌های موردنیاز این پژوهش از طریق مطالعه اسناد و مدارک پرونده جمع‌آوری شده است. نتایج حاصل از این پژوهش نشان می‌دهد که علی‌رغم وجود قوانین و مقررات مشخص در حوزه اجرای احکام، این فرایند با چالش‌هایی جدی مواجه است. برای مثال، طولانی شدن غیرمعمول روند اجرا، عدم شفافیت برخی از مفاهیم حقوقی به‌کاررفته در اسناد قضایی و ناکامی در شناسایی و توقیف اموال محکوم‌علیه، ازجمله مهم‌ترین این چالش‌ها هستند. همچنین، در نقد اجراییه صادره از نظر شکلی و ماهوی، حاکی از وجود نواقصی در نگارش و محتوای این سند بوده است. درنهایت، پژوهشگر با توجه به یافته‌های حاصل از پژوهش، پیشنهاد‌هایی را جهت بهبود روند اجرای احکام ارائه کرده است. این پیشنهادها شامل ساده‌سازی زبان حقوقی به‌کاررفته در اسناد قضایی، بهره‌گیری از ایده‌های نوین در فرایند اجرا، شفاف‌سازی قوانین و تقویت همکاری بین دستگاه‌های مختلف است. با اجرایی شدن این پیشنهادها می‌توان به بهبود چشمگیر عملکرد روند اجرای احکام مالی و افزایش رضایت‌مندی مراجعین امیدوار بود.

with the aim of evaluating the efficiency of the financial judgment enforcement system in iranand identifying the obstacles and challenges in this process, this research has analyzed, in adescriptive-analytical manner, a real judicial case, and criticized the execution issued by the courtand the steps of execution of the judgment. the data required for this research was collectedthrough the study of case documents and the results of this research show that despite the existenceof specific laws and regulations in the field of enforcement, this process faces serious challenges;for example, the unusual prolongation of the execution process, the lack of transparency of somelegal concepts used in judicial documents, and the failure to identify and seize the property of theconvicted person are among the most important challenges. also, the executive criticism issuedin terms of form and substance indicated the existence of deficiencies in the writing and contentof this document. finally, according to the findings of the research, the researcher has madesuggestions to improve the execution process. these suggestions include simplifying the legallanguage used in judicial documents, using new technologies in the implementation process,clarifying laws and strengthening cooperation between different institutions. with theimplementation of these suggestions, we can hope for a significant improvement in theperformance of the financial judgment enforcement system and an increase in the satisfaction ofjustice clients.
