تحلیلی بر جایگاه هوش مصنوعی در دادرسی کیفری

امروزه، هوش مصنوعی با اثبات قابلیت‌ها و کارآمدی خود، جریان انقلاب چهارم را به راه انداخته و همچون موجی عظیم و قدرتمند، همه عرصه‌های زندگی انسان را در بر گرفته و به یاری بسیاری از مشاغل برخاسته است. یکی از حوزه‌های کاربرد هوش مصنوعی در نظام دادرسی بوده که قادر است بهبودها و خلا‌هایی را در فرایند رسیدگی قضایی ایجاد نماید. در این پژوهش با استفاده از ابزار کتابخانه‌ای و روش توصیفی-تحلیلی به شناخت بهتر از تاثیر هوش مصنوعی بر نظام دادرسی پرداخته شد و بدین نتیجه دست یافتیم که با استفاده از هوش مصنوعی می‌توان بهبودهای قابل‌توجهی در کارایی، دقت، سرعت و دسترسی به عدالت در سیستم قضایی داشت. همچنین، ضمن بیان کمبودهای این فناوری در عرصه قضاوت، به این واقعیت پی بردیم که هوش مصنوعی با دارا بودن قابلیت‌های فعلی‌، جایگزین مناسبی برای منصب قضاوت نیست و فقط می‌تواند به‌عنوان وسیله‌ای در خدمت قضات درآید و به آنان در رسیدگی و حل‌وفصل سریع‌تر و دقیق‌تر اختلافات کمک نماید. با توجه به اینکه حقوق ایران در خصوص شرایط قاضی، متاثر از قواعد فقهی بوده و نسبت به دیگر نظام‌های حقوقی در به‌کارگیری هوش مصنوعی در رسیدگی‌های خود عقب‌تر است، لذا با چالش‌هایی در این زمینه مواجه خواهد بود.

today, artificial intelligence has started the fourth revolution by proving its capabilities andefficiency, and it has covered all areas of human life like a huge and powerful wave and has risento the aid of many jobs. one of the fields of application of artificial intelligence is in the judicialsystem, which is able to create improvements and gaps in the judicial process. in this research, byusing library tools and descriptive-analytical methods, a better understanding of the impact ofartificial intelligence on the justice system was discussed and we came to the conclusion that byusing artificial intelligence, significant improvements can be made in efficiency, accuracy, speedand access to justice in the judicial system. also, while expressing the shortcomings of thistechnology in the field of judgment, we realized the fact that artificial intelligence, with its currentcapabilities, is not a suitable substitute for the position of judge and can only serve as a tool forjudges in handling and resolving issues to resolve disputes more quickly and accurately. due tothe fact that iran's law regarding the conditions of the judge is affected by jurisprudence and isbehind other legal systems in applying artificial intelligence in its proceedings, therefore it faceschallenges in this field.
