اختلاف‌نظر موجود در خصوص نوع مجازات عدم رعایت حجاب شرعی در رویه قضایی

امروزه، دشمن با تکیه بر ابزار گوناگون، علی‌الخصوص در حوزه فضای مجازی، همواره به دنبال دستیابی به اهداف شوم خود، ازجمله تضعیف مسئله مهم حجاب در جوامع اسلامی است. قانون مجازات اسلامی جمهوری اسلامی ایران که ریشه در دین مبین اسلام داشته، این وظیفه مهم و شرعی را از واجبات شرعی قلمداد نموده و مخاطبین آن را مکلف به رعایت این مهم کرده است. شرایط حال حاضر کشور، از تلاش‌های متعدد دشمن در این خصوص حکایت دارد. متاسفانه، غالب خواهران نیز در این خصوص فریب بیگانه را خورده و تحریک به انجام این اهداف شوم خواهند شد. عدم رعایت حجاب شرعی در شرایط فعلی، ابتدا این تصور را به ذهن قضات رسیدگی‌کننده ایجاد می‌‌آورد که آیا فاعل عمل، صرفاً از روی هیجان چنین اقدامی را انجام داده و یا اینکه ارتکاب عمل با سوءنیت و هدف قبلی و به جهت تشویق سایر هم‌جنسان و هم‌‌نوعان مرتکب به انجام عمل مشابه بوده است. این موضوع نیز خود موجبات اختلاف‌نظر بین قضات و علی‌الخصوص صدور آرای متضاد را فراهم آورده است. صرف‌نظر از صحت استدلال هر یک از قائلین به هر دو عقیده، به نظر می‌‌رسد در انتخاب نوع بزه و در امتداد آن، تعیین مجازات، می‌‌بایست شرایط حاکم بر کشور را نیز در نظر داشت چراکه تصمیم‌گیری به نحو مطلق در این خصوص، ناصحیح به نظر می‌‌رسد.
