قاعده اهم و مهم، یکی از قواعدی است که در فقه امامیه مورد استفاده واقع شده، مورد مخالفت جدی هیچ فقیهی قرار نگرفته و فقهای امامیه و غیر امامیه بر آن اتفاق‌نظر دارند. ازآنجاکه تشخیص صحیح اهم و مهم به‌عنوان ضابطه در تعیین مصلحت در توان هر کسی نیست و با وجود استثناء فراوان، نقدهای بسیار بر آن وارد است ولی این قاعده منشا عقلی فراتر از نژاد، زبان و فرهنگ دارد، در همه جوامع انسانی کارآمد و ضروری پنداشته می‌شود، در کتب عامه ذیل مصالح و مقاصد شریعت مطرح می‌شود و از امور مهم در تحکیم و اهداف راهبردی خانواده به شمار می‌رود. فقها و حکما، ضمن بیان حریم خصوصی، اطلاعاتی و جسمانی، به بخش‌های حقوق افراد در حریم خصوصی ناشی از این قاعده توجه دارند. مواردی از تزاحم در حقوق خانواده بر اساس این قاعده تبیین شده است. پژوهش کیفی به شیوه کتابخانه‌ای و با استفاده از منابع معتبر علمی گردآوری شده است.
