قبض و بسط مصداقی عدالت در پارادایم مشروعیت دولت در گفتمان سیاسی شیعه

عدالت مطلوب مطلق و غایت دیرینه حیات آدمی است. همین مطلوبیت، ادیان و مکاتب مختلف را به توسل به این مفهوم و موضع‌گیری در قبال آن سوق داده است. اسلام به‌عنوان یک مکتب سیاسی-اجتماعی دربردارنده‌ آموزه‌هایی برای سعادت دنیوی و اخروی انسان است. ازاین‌رو، موضوعات مهمی چون حکومت و فرمانفرمایی و توجیه مبانی و قواعد آن در فقه اسلامی و خصوصاً فقه سیاسی شیعه، کانون مباحث مختلف قرار گرفته است. در نظریات کلان حقوق اساسی، محل طرح انگاره عدالت، مبانی حاکمیت و حکمرانی است و اصولاً از عدالت به‌عنوان مبنایی برای توجیه مشروعیت حکومت‌ها یاد می‌شود که معمولاً در قوانین اساسی مورد تاکید قرار می‌گیرد. ارتباط عدالت با مشروعیت دولت از مهم‌ترین نقاط تلاقی دانش حقوق و سیاست است. بر همین اساس، تبیین این موضوع که اولاً برداشت غالب از عدالت در نظریات متفکرین سیاسی شیعه چیست و ثانیاً این انگاره چه جایگاهی در نظریات مطرح‌شده حول موضوع مشروعیت دولت در گفتمان اسلامی حکمرانی دارد، تعیین‌کننده و درعین‌حال، از جهاتی توجیه‌کننده اشکال حکمرانی و تنوع آن در جوامع اسلامی خواهد بود. این پژوهش درصدد است با رویکردی تاریخی-فلسفی و با محوریت متفکرین شیعی، برخی نظریات مطرح در گفتمان اسلامی حکمرانی را به روش توصیفی-تحلیلی و در راستای اهداف فوق مورد کنکاش قرار دهد.

receiving and extending an example of justice in the paradigm of government legitimacy in shiite political discourse

absolute justice is the ultimate goal of human life. this desirability has led different religions and schools to resort to this concept and take a stand against it. islam as a socio-political school contains teachings for human worldly and otherworldly happiness. therefore, important issues such as government and command and justification of its principles and rules in islamic jurisprudence, especially shiite political jurisprudence, have been the focus of various discussions. in general theories of constitutional law, the idea of justice is based on the principles of sovereignty and governance, and justice is basically referred to as the basis for justifying the legitimacy of governments, which is usually emphasized in constitutions. the relationship between justice and the legitimacy of the state is one of the most important intersections of the knowledge of law and politics. accordingly; explaining the following questions (firstly, what is the predominant perception of justice in the theories of shiite political thinkers? and secondly, what is the place of this idea in the theories about the legitimacy of the state in the islamic discourse of governance?) determines and at the same time justifies the forms of governance and its diversity in islamic societies. this research seeks to explore some of the theories of governance in a descriptive-analytical manner in line with the above-mentioned goals, with a historical-philosophical approach and with the focus on shiite thinkers.
