تاثیر عرف اجتماعی بر نگرش مفسران و فقها در زمینه «عدالت جنسیتی» با تاکید بر نظر کارن بائر

با گذر زمان و تغییر شرایط اجتماعی و فرهنگی هر دوره، تغییر نگرش مفسران و فقها اجتناب‌ناپذیر خواهد بود و دخالت دادن عرف و اقتضائات عصری در رویکرد تفسیری و استنباط‌های فقهی عالمان امری مسلم و حتی لازم به نظر می‌رسد. مباحث مربوط به «عدالت جنسیتی» و «سلسه‌مراتب جنسیتی» از مباحث چالش‌برانگیزی است که عالمان در هر دوره رویکرد خاصی را نسبت به آن اتخاذ کرده‌اند و بی‌تردید عرف جامعه می‌تواند بر نگرش عالمان به این مسائل اثرگذار باشد. کارن بائر در کتاب سلسله‌مراتب جنسیتی در قرآن: تفاسیر کهن، پاسخ‌های نو با اتخاذ این مبنا که برخی از آیات قرآن کریم مفهوم «سلسله‌مراتب جنسیتی» را دربردارند به بررسی تاریخی (درزمانی) تفاسیر مرتبط با آیات مذکور در منابع تفسیری سده‌های میانی تا مدرن پرداخته و ادعا می‌کند عرف اجتماعی بر شکل‌گیری نظریات تفسیری و فقهی موثر بوده است. در این پژوهش، ضمن ترجمه و دسته‌بندی اظهارنظرهای بائر، ادعای او در مورد تاثیر عرف اجتماعی بر تفسیر مفسران و استنباط‌های فقها به روش توصیفی-تحلیلی تبیین و نگرش عالمان نسبت به «عدالت جنسیتی» بررسی می‌شود. بر اساس نتایج مبتنی بر این تحقیق، در سده‌های میانی که عرف جامعه به برتری مردان متمایل بود، «سلسله‌مراتب جنسیتی» عین عدالت محسوب می‌شد؛ اما در دوره معاصر که عرف مقبول جامعه، تساوی زن و مرد است، «سلسله‌مراتب جنسیتی» ناقض عدالت در نظر گرفته می‌شود. در این میان، برخی عالمان تجدیدنظرطلب معتقدند در راستای عدالت جنسیتی، باید آیات ناظر بر سلسله‌مراتب جنسیتی بازتفسیر و احکام سنتی زنان با احکامی متناسب با عصر حاضر جایگزین شود. بی‌تردید، عرف اجتماعی می‌تواند به تفسیر دوباره آیات و تحول احکام منتهی شود؛ اما باید توجه داشت «عدالت جنسیتی» از منظر اسلام آن است که زن و مرد، با پذیرش تفاوت‌های طبیعی خود در نقش‌هایی متناسب با توانمندی‌های جسمی و روحی خویش قرار گیرند تا زمینه‌ساز سلامت خانواده و پویایی جامعه باشند.

the effect of social custom on the attitudes of interpreters and jurists on “gender justice” with emphasis on karen bauer’s opinion

the attitudes of interpreters and jurists inevitably change with the passage of time and the changing social and cultural circumstances of each period. incorporating contemporary custom and requirements into scholars’ interpretive approaches and jurisprudential conclusions seems inevitable, even necessary. the issues related to “gender justice” and “gender hierarchy” are among the challenging issues that scholars have adopted a specific approach to in each period, and undoubtedly, the customs of society can affect the scholars’ attitudes towards these issues. karen bauer, in her book gender hierarchy in the qur’an: ancient interpretations, new responses, taking the premise that some verses of the qur’an contain the concept of “gender hierarchy,” conducts a historical (chronological) study of interpretations related to the aforementioned verses in interpretive sources from the middle ages to the modern era, and claims that social custom has been effective in shaping interpretive and jurisprudential theories. in this study, while translating and categorizing bauer’s comments, her claim about the influence of social custom on the interpretation of commentators and the inferences of jurists has been examined using a descriptive-analytical method to explain and examine scholars’ attitudes towards “gender justice.” according to the results of this study, in the middle ages, when social custom tended to favor male supremacy, “gender hierarchy” was considered the same as justice. however, in the contemporary era, when the accepted norm of society is equality between men and women, the “gender hierarchy” is considered a violation of justice. in the meantime, some revisionist scholars believe that in order to achieve gender justice, the verses regarding gender hierarchy should be reinterpreted and the traditional rulings on women should be replaced with rulings that are appropriate for the present era. undoubtedly, social custom can lead to the reinterpretation of verses and the evolution of rulings. however, it should be noted that “gender justice” from the perspective of islam means that men and women, by accepting their natural differences, should be placed in roles that are appropriate to their physical and mental capabilities in order to create the basis for family health and the dynamism of society.
