تاثیر به‌کارگیری ابزار یادگیری ماشین در نظام دادرسی حقوق نوشته با نگاهی به تجربۀ جمهوری خلق چین و کاربست آن در نظام قضایی ایران

هدف هر نظام حقوقی توسعۀ نظم اجتماعی و عدالت همگانی ازطریق حل‌وفصل مسائل آحاد افراد جامعه است. به‌نظر می‌رسد با گسترش فنّاوری‌های نوین، رسیدن به این هدف با سرعت بیشتری قابل تعقیب است. دو نظام حقوقی سرآمد در سطح جهان، یعنی نظام حقوق رومی ژرمنی با اعمال مقررات موضوعه و نظام حقوق کامن‌لا با تکیه بر رویۀ قضایی، منبع الهام‌بخش بسیاری از نظام‌های حقوقی کشورها هستند. در این پژوهش، با تکیه بر تجارب سیستم قضایی نوشتۀ چین در بهره‌گیری از هوش مصنوعی، که با روش تحقیق تحلیلی توصیفی و استفاده از ابزار کتابخانه‌ای بررسی شده است، به‌دنبال پاسخ به این پرسش هستیم که درصورت به‌کارگیری ابزار یادگیری ماشین، که برمبنای یافتن الگو در آرای مشابه استوار است، آیا نظام حقوق نوشته چهارچوب سنتی خود را از دست خواهد داد و به‌نوعی در نظام حقوقی کامن‌لا هضم خواهد شد؟ به‌نظر می‌رسد تابعان نظام حقوق نوشته با حفظ اصول خود به هم‌گرایی با نظام حقوق کامن‌لا دست یابند؛ بدون این‌که ریشه‌های استوار بر قانون نوشته را از دست بدهند.

the effect of using machine learning tools on the civil law judiciary system with a look at the experience of the people’s republic of china and its usage in the iranian judicial system

the goal of any legal system is to develop social order and justice for all through solving the disputes of individual members of society. it seems that with the development of new technologies, reaching this goal can be pursued more quickly. the two leading legal systems in the world, the roman-german legal system with the application of codified regulations and the common law system relying on precedents, are the source of inspiration for many countries’ legal systems. in this research, with the look at the experiences of the chinese judicial system in the use of artificial intelligence, which has been using the descriptive analytical research method and library tools, we are looking for an answer to the question of whether machine learning tool based on finding patterns in similar decisions is used, will the civil law system lose its traditional framework and in some way integrated into the common law system? it seems that the subordinates of the civil law system can achieve convergence with the common law system by maintaining their principles without losing the roots based on civil law.
