داوری اختلافات مربوط به قراردادهای هوشمند

امروزه استفاده از قراردادهای هوشمند در عرصه‌های مختلف تجاری رواج یافته است. با وجود این، ممکن است این قراردادها موضوع اختلافات متعددی قرار گیرند , برای نحوۀ حل‌وفصل آن‌ها باید روشی اتخاذ شود که با ماهیت این قرارداد‌ها سازگاری بیشتری داشته باشد. در این مقاله، داوری به‌منزلۀ روش مناسبی برای حل‌و‌فصل این اختلافات پیشنهاد شده است. مقالۀ حاضر به روش تحلیلی توصیفی و براساس منابع کتابخانه‌ای انجام شده است و به تحلیل ابعاد گوناگون استفاده از داوری در حل‌وفصل اختلافات قرارداد‌های هوشمند و چالش‌های پیش‌روی آن پرداخته است. بررسی‌ها نشان می‌دهند آنچه لازم است ساختار داوری سریع، ارزان، شفاف و اطمینان‌بخشی است که دارای صلاحیت قضایی غیرمتمرکز در کل زنجیرۀ بلوکی باشد و قضاوت نهایی ارائه دهد. به‌نظر می‌رسد استفاده از روش داوری برای حل اختلافات قراردادهای هوشمند، ترکیبی از سرعت، اعتماد، شفافیت، هزینۀ کم و اجرای سریع بدون نیاز به اتکا به دولت یا هرگونه واسطه‌ای را به ارمغان خواهد آورد.

arbitration of disputes related to smart contracts

nowadays, the use of smart contracts has become widespread in various commercial fields. however, these contracts may also be the subject of many disputes, which must be resolved in a way that is more compatible with the nature of this contract and should be adopted. this article suggests arbitration as a suitable method to resolve these disputes. this present article has been done in an analytical-descriptive way and based on library sources, and it deals with the analysis of different aspects of the use of arbitration in the resolution of smart contract disputes and the challenges facing it. studies show that what is needed is a fast, cheap, transparent and reliable arbitration structure system that has decentralised jurisdiction in the entire blockchain and provides the final judgment. it seems that using the arbitration method to resolve smart contract disputes will bring speed, trust, transparency, low cost and quick implementation without relying on the government or any intermediaries.
