متاورس و چالش‏های حقوقی در حوزۀ حقوق اموال

متاورس یا فراجهان، ترکیبی از دنیای واقعی و مجازی، در کنار ایجاد امکانات و فرصت‏ های جدید در حوزه ‏های گوناگون چالش‏ هایی را نیز برای مردم و دولت ‏های جهان به همراه خواهد داشت. مسائل حقوقی نیز گسترۀ بزرگی از تعامالات اشخاص در فضای متاورس را با چالش مواجه خواهد کرد. این جستار در پی آن است که اولاً ضمن بازگشایی بابی در نظر حقوقدانان به پرسش اصلی بپردازد که اشیای موجود در متاورس تملک‏ پذیرند یا خیر. در این مقاله، با طرف‏داری از تملک ‏پذیری اشیای مجازی به‏ طور کلی، چهار نظریۀ مالکیت ارائه شده است که از آن‏ها با عنوان نظریۀ کار لاک، نظریۀ شخصیت هگل، نظریۀ فایده‏گرایی بنتام و نظریۀ بازدارندگی از سرقت لجروود یاد می ‏شود سپس موضوع وفق مبانی فقهی و حقوقی بررسی شده است. این رهیافت دنبال شده است که اشیای مجازی، با این فرض که مالیت عرفیه دارند، قابلیت تملیک و تملک را دارند.

metaverse or the second life, as a combination of the real and virtual worlds, besides creating new facilities and opportunities in various fields, will also bring challenges to the people and the states. legal issues will also challenge a large range of interactions between individuals in the metaverse. this essay first addresses the main question of whether the objects in the metaverse can be owned while opening a chapter on the opinion of jurists. in favour of the ownership of virtual objects, this article has presented four theories of ownership: locke’s work theory, hegel’s personality theory, bentham’s utilitarianism theory and ledgerwood’s theft deterrence theory. the matter has been dealt with according to jurisprudence and legal principles too. this approach has been followed in that virtual objects can be owned with the assumption that they are property in view of the custom.
