کارکردها و بایسته‌های هوش مصنوعی از منظر دادرسی منصفانه

حق بر استفاده از فناوری‌های نوین همواره یکی از حقوق اساسی بشر قلمداد شده است و اسناد حقوق بشری متعددی همانند اعلامیۀ اروپایی حقوق دیجیتال و اصول برای دهۀ دیجیتال و میثاق بین‌المللی حقوق اقتصادی، اجتماعی و فرهنگی بر این مهم صحه گذاشته‌اند. از جملۀ این فناوری‌های نوین، فناوری هوش مصنوعی است که در نسل‌های چندگانۀ حقوق بشر تاثیرات فراگیری داشته و یکی از کارکردهای آن به‌کارگیری این هوش در فرایند دادرسی قضایی است. در پژوهش پیش‌رو، صورت‌های به‌کارگیری هوش مصنوعی در فرایند دادرسی قضایی و اصول و بایسته‌های آن را با روش تحقیق تحلیلی توصیفی و استفاده از ابزار کتابخانه‌ای بررسی شده است. نتایج این پژوهش حاکی از آن است که هوش مصنوعی این قابلیت را دارد که به صورت ابزار پیشگیری، ابزار تصمیم‌سازی (دستیار قاضی) و ابزار تصمیم‌گیری (قاضی مستقل) در فرایند دادرسی به‌کار گرفته شود و چنانچه در الگوریتم طراحی‌شده برای هوش مصنوعی اصولی مانند حاکمیت قانون، برابری و عدم‌تبعیض، استقلال و بی‌طرفی و شفافیت نهادینه شود و این الگوریتم را منصفانه گرداند، بهره‌گیری از آن به دادرسی منصفانه خواهد انجامید.

functions and requirements of artificial intelligence in the light of fair trial

the right to use new technologies is one of the fundamental rights and several legal documents from the european declaration of digital rights and the principles of the digital decade and the international covenant on economic, social and cultural human rights. among these new technologies is artificial intelligence technology, which has had a pervasive impact on multiple generations of human rights, and one of its functions is to use this intelligence in the process of judicial proceedings. the current research has investigated the different forms of using artificial intelligence in the process of judicial proceedings and its principles and requirements with the descriptive analytical research method and the use of library tools. the results of this research indicate that artificial intelligence can be used as practical tools, tools (assistant judge) and decision-making tools (independent judge) in the judicial process, and the change in the algorithm designed for artificial artificial tools such as law is equality. and non-discrimination, independence and impartiality and institutional transparency and make this algorithm fair, artificial intelligence can achieve a fair trial.
