چالش های اخلاقی و حقوقی فناوری تولید انسان هیبریدی (ترکیب انسان -حیوان)

تلاش‌های صورت‌گرفته در پزشکی و علم مهندسی بافت حاکی از آن است که تولید بافت‌ها و اندام‌های انسانی در داخل ترکیبات حاصل از سلول‌های انسان حیوان از طریق فنّی به نام مکمل بلاستوسیست بین‌گونه‌ای امکان‌پذیر می‌شود. ایجاد کایمرا‌های انسان حیوان این امکان را به دنیای پزشکی می‌دهد که برخی ویژگی‌های مشترک انسان یعنی سلول‌های بنیادی‌اش را درون بدن جانداران دیگر بیازماید. مزایای متعدد ازجمله تولید اندام‌های انسانی در بدن حیوانات و در نهایت استفاده از آن‌ها در اعمال جراحی پیوند عضو از مهم‌ترین دستاوردهای پزشکی بازساختی است. در این مقاله، با رویکردی تحلیلی، رژیم حقوقی حاکم بر این فناوری مهم تبیین شده است. ازآنجاکه نشئۀ انسانی الوهیتی است و کرامت ذاتی بر بندبند سلول‌های زندۀ انسان از بدو تولد حاکم است، به‌نظر می‌رسد چالش‌های حقوقی حاکم بر انسان هیبریدی، که ترکیبات سلولی انسان را در خود دارد، به پاس این موهبت، یعنی وصف انسانی‌بودن، دارای اهمیت ویژه‌ای است که باید در رویکردهای پزشکی نوین و مهندسی بافت مدنظر قرار گیرد.

ethical and legal challenges of hybrid human production technology (human-animal hybrid)

efforts in medicine and tissue engineering have shown that the production of human tissues and organs within compounds of human-animal cells is possible through a technique called interspecific blastocyst complement. the creation of human-animal chimeras allows the medical world to test some of the common features of humans, namely their stem cells, in the bodies of other living things. among regenerative/reconstructive medicine’s significant achievements are numerous benefits, including the production of human organs in animals and their ultimate use in organ transplant surgery. this article uses an analytical approach to explain this vital technology’s legal regime. since human essence and soul are divine, and inherent dignity governs the bondage of living human cells from birth, the legal challenges to hybrid human which contain cellular composition, seem to be due to this gift, namely. the description of being human is of particular importance that should be considered in modern medical and tissue engineering approaches.
