روش‌های انصراف از قراردادهای الکترونیکی در قانون تجارت الکترونیکی ایران

یکی از مسائل مهم قراردادهای الکترونیکی انصراف از این قراردادها است. سوال اساسی پژوهش پیش رو این است که با کدام روش‌‏ها می‌‏توان از قرارداد الکترونیکی انصراف داد؟ روش این پژوهش در یافتن پاسخ این پرسش توصیفی و تحلیلی با استناد به روش کتابخانه‌‏ای و نیز استنباط از مواد قانونی است. توضیح این‌‏که مواد قانون تجارت الکترونیکی ایران مصوب 1382 برای ارائۀ روش‏‌های انصراف از قراردادهای الکترونیکی و حل ابهام موجود مبنای این پژوهش قرار گرفته و روش‌‏های انصراف از قراردادهای الکترونیکی با استناد به روش تحلیل عقلانی و استنباط حقوقی ارائه شده است. بنابر نتایج پژوهش، دو روش فیزیکی و الکترونیکی در انصراف از قراردادهای الکترونیکی وجود دارد. ازآنجاکه این پژوهش هم نخستین کار علمی دربارۀ این مسئله و هم پژوهشی کاربردی است، نتایج آن برای حقوق‌دانان، وکلای دادگستری، قضات دادگاه‏‌ها و داوران در تفسیر مواد قانون تجارت الکترونیکی ایران دربارۀ روش‌‏های انصراف قراردادهای الکترونیکی کاربرد خواهد داشت.

one of the critical issues of electronic contracts relates to their withdrawal. the essential question of recent research is which methods can withdraw electronic contracts. the method of this research in finding mentioned question answers that the article on iranian e-commerce code has put the base of comparative study for presenting the withdrawal methods of electronic contracts and solving the existing ambiguity. it has acquired and presented the withdrawal methods of electronic contracts on the strength of intellectual analysis and legal inference. it has been concluded that there are two physical and electronic methods for cancelling electronic contracts. since this research is the first scientific search in issue and practical research, its results will be used by law scholars, attorneys, judges of courts, and arbitrators in interpreting the articles of the e-commerce code regarding withdrawal methods of electronic contracts.
