رویکردی نوین در تنظیم گری فضای مجازی

فضای مجازی از بسیاری جهات دنیای جدیدی را خلق کرده است. این پدیدۀ آنلاین دارای ابعاد فرهنگی، اجتماعی، اقتصادی و قانونی است. با وجود بحث‏‌های جامعی که دربارۀ مبانی و اصول چارچوب فضای مجازی در جهان صورت گرفته است، زمینه‏‌های نظریِ آن همچنان سست به‏‌نظر می‌‏رسد. بنابراین، در این مقاله به مشکلات ناشی از نظم هنجاریِ موجود در فضای مجازی، یعنی ابزارهای قانونی، پرداخته شده است. همچنین، تلاش شده مشکلاتی بررسی شود که در زمان اعمالِ این نظم هنجاری در دنیای «واقعی» پدید می‌‏آید و به‌‏تبع آن، این امر تبدیل به چالشی برای سازگارشدن با فناوری‌‏های اطلاعاتی می‌‏شود که روبه رشدند. در واقع، چارچوب موجود که قوانین ملی و برخی از معاهدات چندجانبه را دربر می‏‌گیرد، «ابزارهای» مناسبی را در روابط حاکم در فضای مجازی در اختیار ما قرار نمی‌‏دهد. یکی از مشکلات اصلی غلبه بر تنش‌‏های کنونی برای «به‌‏کارگیریِ» هنجارهای قانونیِ موجود در فضای مجازی این است که حتی رویکردهای نظریِ جدید تلاش کافی برای نهادینه‏‌شدن پیشرفت فناوری در نظام بین‌‏المللی نمی‏‌کنند. در این مقاله، با بهره‌‏گیری از رویکرد میان‏‌رشته‏‌ای حقوق عمومی و اقتصاد، قابلیت اجرای مفاهیم قانونی مختلف برای فرایندهای تنظیم‏گری در فضای مجازی معرفی شده و مورد بحث و بررسی قرار گرفته است.

a new approach to cyberspace regulation

to a great extent, cyberspace has managed to create a new world. this online phenomenon contains cultural, social, economic and legal aspects. in the meantime, even though there have been detailed discussions about the basics and principles of the cyberspace framework around the world, the theoretical background of this phenomenon still proves fragile. accordingly, the present research examines the problems arising from the normative order in cyberspace, namely legal tools, and the problems that arise when applying for this normative order in the &real& world. as a result, these problems become a challenge facing the process of adapting to the growing information technology. in fact, the existing framework, which covers national laws and some multilateral treaties, fails to provide us with appropriate &tools& in dealing with cyber-relations. one of the significant problems in overcoming current tensions to &apply& existing legal norms in cyberspace is that even new theoretical approaches do not make adequate efforts to institutionalize technological advances in the international system. this research intends to introduce and discuss the capability of implementing various legal concepts for regulatory processes in cyberspace, using the interdisciplinary approach - public law and economics.
