بررسی تطبیقی مواد شرایط عمومی فیدیک قرمز و عمومی پیمان نشریه 4311

قراردادهای همسان مختلفی در کشور ما و همچنین در کشورهای دیگر تنظیم شده است که برخی از آن‌ها رسماً بین‌المللی و برخی دیگر به طور غیررسمی بین‌المللی شناخته می‌شوند. هدف از تحقیق حاضر مقایسه و تطبیق شرایط عمومی پیمان سه عاملی ایران و فیدیک قرمز است که یکی از مهم‌ترین قراردادهای اداری پیمان است. شرایط عمومی پیمان فیدیک بین‌المللی و شرایط عمومی پیمان سه عاملی ایران در داخل کشور حاکم است. به‌طورکلی نتایج حاصل از این تحقیق نشان داد ازآنجاکه هر دو این شرایط عمومی جزو شرایط عمومی سه عاملی هستند˓ شرایط عمومی پیمان فیدیک که دارای 73 ماده است با شرایط عمومی پیمان سه عاملی ایران که 54 ماده دارد ˓دارای مشابهت‌های زیادی هستند؛ اما در بعضی موارد نظیر دعاوی، آموزش، تخصیص ریسک و ایمنی تفاوت‌هایی دارند به طور مشخص در فیدیک اختیارات مهندس مشاور بسیار بیشتر است. استفاده از شرایط عمومی پیمان فیدیک بدون انجام اصلاحات و اضافه نمودن موارد تکمیلی با مدنظر قراردادن قوانین و مقررات در ایران قابل‌اجرا نمی‌باشد. در این پژوهش به بررسی دقیق موارد تفاوت و ارزیابی آنها پرداخته و موارد به‌صورت تطبیقی بیان شده است.

various similar agreements have been established in our country as well as in other countries, some of which are officially international and others are unofficially recognized as international. the purpose of this research is to compare and apply the general conditions of the three-party agreement between iran and red fidic, which is one of the most important administrative contracts of the agreement. the general conditions of the international fidic agreement and the general conditions of the three-party agreement with iran prevail inside the country. in general, the results of this research showed that since both of these general conditions are among the three-party general conditions, the general conditions of the fidic agreement, which has 73 articles, and the general conditions of the three-party agreement of iran, which has 54 articles, have many similarities. but in some cases, such as lawsuits, training, risk allocation, and safety, there are differences. specifically, in fidic, the consulting engineer's powers are much greater. the use of the general conditions of the fidic agreement is not applicable without making amendments and adding additional items by considering the laws and regulations in iran. in this research, we have carefully investigated the differences and expressed them in a comparative manner.
