بررسی مولفه‌های غیر ساختاری فقه حکومتی در تمدن‌سازی اسلامی در منظومه فکری آیت‌الله خامنه‌ای

بررسی مولفه‌های ساختاری و غیرساختاری تمدن‌سازی اسلامی از مسائل محوری منظومه فکری آیت‌الله خامنه‌ای می‌باشد. بر این مبنا جهت شناخت مولفه‌های غیرساختاری فقه حکومتی(که با فقه سیاسی و فقهِ حکومت مساوق نمی‌باشد)  به طرح این سوال اصلی پرداخته شده است که در راستای اندیشه ایشان مهمترین مولفه‌های غیر ساختاری فقه حکومتی در فرایند تمدن سازی اسلامی چه مواردی می باشد؟ برای این منظور در این نوشتار تلاش شد با استفاده از روش تحلیل سیستمی، شاخصه های غیر ساختاری فقه حکومتی در تمدن سازی اسلامی در اندیشه ایشان تحلیل و در نهایت دستاورد نهایی پژوهش این شد که شرایط استفاده از ظرفیت‌های فقه حکومتی در فرایند تمدن‌سازی عبارتند از: شرایط علّی: تحقق رویکرد منظومه‌ای به فقه، مراعات مصلحت، زمان و مکان در فرایند استنباط و رعایت غایات شارع در متن جامعه در استنباط احکام. شرایط زمینه‌ای: ایجاد و سازماندهی افراد و گروه‌های تحقق بخش فقه حکومتی. راهبردها: تسهیل فرایند شهروندی در استنباط احکام(کارآمدی) و تبدیل احکام فقهی به قوانین الزام آور است پیامدهای استفاده از ظرفیت های فقه حکومتی برآورده کردن نیازهای جامعه، تحقق عملی جامعیت دین، بهره گرفتن از همه ابواب فقه و تعمیم جغرافیای مخاطبان است

the study of the structural and non-structural components of islamic civilization building is one of the central issues of ayatollah khamenei's intellectual system. on this basis، in order to identify the non-structural components of governmental jurisprudence (which is not consistent with political jurisprudence and government jurisprudence)، the main question has been raised: what are the most important non-structural components of governmental jurisprudence in the process of islamic civilization building، according to his thought? for this purpose، this article attempted to analyze the non-structural characteristics of governmental jurisprudence in islamic civilization building in his thought using the method of systemic analysis، and ultimately the final achievement of the research was that the conditions for using the capacities of governmental jurisprudence in the process of civilization building are: causal conditions; realization of a systematic approach to jurisprudence، consideration of expediency، time and place in the process of inference and observance of the goals of the legislator in the context of society in inferring rulings. contextual conditions; creation and organization of individuals and groups that implement governmental jurisprudence. strategies; facilitating the citizenship process in deducing rulings (efficiency) and transforming jurisprudential rulings into binding laws. consequences: meeting the needs of society، practically realizing the comprehensiveness of religion، benefiting from all branches of jurisprudence، generalizing the geography of the audience.
