آزادی به ‌مثابۀ اصل حاکم بر مردم‌سالاری در اندیشۀ فرخی یزدی

هدف این نوشتار بررسی مفهوم آزادی و مقوله‌های مختلف آن، به‌ویژه آزادی بیان در اشعار فرخی یزدی با رویکردی بین رشته ای و از منظری حقوقی است؛ از این منظر، مفهوم آزادی با مفهوم «حق داشتن» گره می‌خورد و آزادی عبارت می‌شود از: نبودِ مانع و فقدان محدودیت. آزادی همانند مفاهیمی چون عدالت و نظم عمومی، انتزاعی است که به ویژه در علوم مختلف مورد مناقشه و تفاسیر متعدد قرار گرفته است. از طرفی آزادی به ‌عنوان یکی از اصول حاکم بر مردم‌سالاری به شمار می رود و از سویی دیگر این آزادی در اشعار شعرا دارای جایگاهی سترگ و والاست؛ پس آدمی در برابر اندیشه‌ای که خواهان گرفتن حقوق اساسی وی بوده است، دست به رویکردی متنازع می‌زند؛ از این رو آزادی امری مهم و بنیادین تلقی می‌شود؛ چراکه انسان را به امری سوبژکتیو بدل می‌کند. شروع سویه‌های این تقابل در ایران را می‌توان در دورۀ مشروطه یافت. متفکرین عصر مشروطه که تحت‌ تاثیر این نگرش قرار داشتند، سعی در اثبات مفهوم آزادی به‌ عنوان یک حق کردند. یکی از متفکرین دورۀ مشروطه که در بطن این مناقشه قرار داشت، فرخی یزدی بود. اگرچه فرخی در باب بیان آزادی و ضرورت آن برای دموکراسی در اشعار خود به گونة مستقیم نپرداخته است؛ اما درصدد دستیابی به ‌نوعی از دموکراسی در زمانۀ خویش بوده است که لازمۀ تحقق آن، رسیدن به انواع آزادی‌هایی است که امروزه در اسناد متعدد بشری در زمرۀ آزادی‌های بنیادین بشری قرار گرفته است. حال پرسش اینجاست که منظور فرخی یزدی از آزادی، کدام مصادیق از آزادی است؟ برای یافتن پاسخی درخور، به استفاده از روشی توصیفی و تحلیلی روی می‌آوریم و تلاش برای یافتن پاسخ را با پرداختن به مفهوم آزادی و انواع آن در قالبی حقوقی گره می‌زنیم. این‌گونه پیوندی نیک و میان‌رشته‌ای میان ادبیات و حقوق برقرار می‌شود.

freedom as the governing principle of democracy in farrokhi yazdi’s thought

the present paper examines the concept of freedom and its different categories, and more specifically, the freedom of speech in the poetry of farrokhi yazdi from a legal perspective. according to this view, freedom is tied up with the concept of &having a right to& and it is defined as an absence of obstacles and limitations. freedom, similar to justice and public order, is an abstract concept which has been debated and interpreted differently from the perspective of different sciences. on the one hand, freedom has been established as one of the governing principles of democracy, and on the other hand, it has occupied a high position in literary expressions, especially, in poetry. naturally, an individual would oppose a view which seeks to crucify one’s fundamental rights, and freedom is considered as one of these rights because it turns a human being into a subject. in iran, the beginning of some aspects of such confrontational views can be found in the constitutional era. thus, the thinkers of this era, also influenced by this view, tried to prove the existence of the concept of freedom as a right. farrokhi yazdi was one of such thinkers who was at the heart of this conflict. even though he did not directly address the concept of freedom and its necessity for democracy in his poems, his goal was to achieve a kind of democracy the materialization of which depended on achieving the types of freedom which, in various documents, are considered among fundamental human freedoms today. now the question is, what kinds of freedom does farrokhi yazdi mean by freedom? to find the answer, we draw on a descriptive and analytical method and tie the research to the law and legal matters.
