تحلیل تاریخی موضوع زناشویی و تربیت کودک از دیدگاه فقیهان اسلامی با تاکید بر مفهوم تمکین

هدف پژوهش حاضر، تحلیل تاریخی موضوع زناشویی و تربیت کودک از دیدگاه فقیهان اسلامی با تاکید بر مفهوم تمکین است. از عوامل موثر در انفعال زنان در فضای خانواده و محیط جامعه تمکین زن در مقابل شوهر است که در پی آن تنافی احتمالی حق تمکین شوهر با اشتغال، تحصیل، خروج از منزل، عبادات مستحبی و در دیگر مسائل مطرح می‌شود در مقابل تمکین بحث نشوز وجود دارد که در آیات و روایات در مورد آن صحبت شده است و همچنین در کتب فقهی بیشتر درباره آن بحث شده است و با کشف معنای آن می‌توان به معنای تمکین دست یافت البته در عبارت‌های فقهاء خصوصاً متاخرین بحث تمکین به صورت صریح بحث شده است در بین فقهای شیعه از صدر اسلام تا الان در مورد ماهیت تمکین و حد و حدود آن نظرات مختلفی مطرح شده است در این تحقیق در مورد تعریف تمکین از نظر اهل بیت عصمت و طهارت علیهم السلام و فقهای عصر غیبت صغری و کبری تا زمان حاضر بحث شده و به صورت تحلیلی و دقیق و با بررسی عبارت‌های آنها به این نتیجه رسیده است که تمکین از نظر آنها به معانی مختلف از جمله به معنای تمکین خاص، تمکین عام، اطاعت از شوهر در رفتار، اطاعت از شوهر در رفتار و گفتار، اطاعت از خواسته‌های جنسی و لوازم آن آمده است.
