امتیازات سرمایه‌گذاری اقتصادی و بازرگانی (فرآورده‌های غیرنفتی) در کشورهای آفریقای جنوبی از منظر حقوق بین‌الملل

زمینه و هدف: مسئله رشد اقتصادی در کشورهای جهان سوم دارای اهمیت بسزایی است؛ به همین منظور کشورهای جهان سوم، سرمایه‌گذاری خارجی را به منظور برون رفت از مشکلات انتخاب می‌کنند. کشور آفریقا دارای منابع بی‌شماری است که در حال حاضر تبدیل به قطب سرمایه‌گذاری شده است. کشور ایران با سرمایه‌گذاری در آفریقا از مزیت سرمایه‌گذاری به دلیل تحریم‌ها و استفاده از منابع غنی بهره‌مند می‌گردد. هدف این پژوهش تحلیل سرمایه‌گذاری غیرنفتی ایران در آفریقا با توجه به حقوق بین‌الملل است.مواد و روش‌ها: این تحقیق از نوع نظری بوده و روش آن به صورت توصیفی تحلیلی می‌باشد و ابزار جمع‌آوری اطلاعات نیز بصورت کتابخانه‌ای است.ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.یافته‌ها: یافته‌ها حاکی از این است که سرمایه‌گذاری خارجی برای ایران دارای مزیت است، زیرا منافع اقتصادی فراوان همراه با تحریم‌های ایران گامی موثر در جهت پیشبرد اهداف کشور است.نتیجه: سرمایه‌گذاری ایران در قاره آفریقا از نظر حقوقی نیازمند تضمیناتی مانند سلب مالکیت، انتقال سرمایه، امنیت حقوقی و پوشش بیمه‌ای است.

the economic and commercial investment privilages of non- oil products in the countries of south africa from the perspective of international law

background and aim: the issue of economic growth in third world countries is of great importance. for this reason, third world countries choose foreign investment as a solution to overcome their problems. the country of africa has countless resources and it now  has become an investment hub. by investing in africa, iran benefits from the investment advantage due to sanctions and the use of rich resources. the purpose of this research is to analyze iran's non- oil investment in africa according to international law.materials and methods: the present  study  is of a theoretical nature and its method is descriptive and analytical .data collection method is library tool. ethical considerations: in all stages of writing this article ,the principles of text origionality,honesty and trustworthiness have been observed.findings: the findings indicate that foreign investment has an advantage for iran, because huge economic resources along with sanctions on iran,  have been   effective steps towards advancing the country's goals.results: iran's investment in the african continent requires legal guarantees such as expropriation, capital transfer,legal security and insurance coverage.
