مسئولیت‏ مدنی نقص کالاهای تولیدی برای تولید‏کنندگان در حقوق ایران و عراق

زمینه و هدف: مصرف‌کنندگان نیازمند حمایت های قانونی قانونگذار می‌باشند، به همین دلیل، سیستم‌های حقوقی اکثر کشورها‌ با توجه به این موضوع این‌، تلاش‌ نموده تا با در نظر گرفتن‌ مسئولیت‌ تولیدکننده‌ در زمینه وجود نقص در کالاهای تولیدی به‌ حمایت‌ از افراد مصرف‌کننده،‌ مبادرت نمایند. هدف از این پژوهش تبیین مسئولیت های تولید کننندگان کالا در زمینه نقص کالاهای تولیدی در سیستم های حقوقی ایران و عراق می باشد.مواد و روش‌ها: روش این پژوهش توصیفی تحلیلی است.ملاحظات اخلاقی: در نگارش مقاله اصالت متون، صداقتداری و امانتداری رعایت شده است.یافته‌ها: در سیستم های حقوقی ایران و عراق، مسئولیت مدنی افراد تولیدکننده مورد پذیرش قرار گرفته است. مسئولیت مدنی از مسئولیت قراردادی شروع و به مسئولیت محض منتهی می شود. مسئولیت مدنی تولیدکنندگان در قانون ایران بر نظریه تضمین ایمنی کالا استوار است.نتیجه: در سیستم‌های حقوقی کشورهای ایران و عراق، در زمینه مسئولیت تولید کنندگان کالا، نظریه مسئولیت‌ محض‌ با توجه‌ به‌ گستردگی دامنه خود‌، بستر حمایتی‌ را برای‌ افراد مصرف‌‌کننده‌ کالا در نظر گرفته است. در حقوق‌ کشور ایران‌، بر اساس قانون‌ حمایت‌ از مصرف‌‌کنندگان‌، دیدگاه‌ مسئولیت‌ محض‌ مورد توجه و پذیرش قانون‌گذار قرار گرفته است.

background and purpose: consumers need legal protection by legislator,for this reason ,the legal systems of most countries have tried to support consumers by taking into account the liability of producers in the case of any defects in manufactured goods the purpose of present study is to determine product producers liability in the case of products defect in legal systems of iran and iraq .method and materials: the research method is descriptive_analytical.ethical consideration: in writing present paper, the principles of text origionality,honesty,and trustworthiness have been observed.finding: in the legal systems of iran and iraq, the civil responsibility of producers has been accepted. civil liability starts from contractual liability and leads to absolute liability. the civil responsibility of producers in iranian law is based on the theory of guaranteeing product safety.result: in the legal systems of the countries of iran and iraq, in the field of responsibility of producers of goods, the theory of pure responsibility, considering its wide scope, has considered a support platform for people who consume goods. in the law of iran, based on the consumer protection law, the view of pure responsibility has been taken into consideration and accepted by the legislator.
