رعایت غبطه صغیر در روابط مالی ناشی از ازدواج

زمینه و هدف: اختیار پدر و جد پدری در نکاح دختر و پسراز احکام مسلم فقهی است. رعایت مصلحت صغیر با نظرات فقهی همراستا می‌باشد. فقها معتقدند که در تزویج ولایی صغیر، عدم مفسدت کفایت می‌کند. هدف از پژوهش، تحلیل رعایت صغیر در خصوص روابط مالی ناشی از نکاح است.مواد و روش‌ها: روش انجام این پژوهش توصیفی تحلیلی است.ملاحظات اخلاقی: در این پژوهش اصالت متون، امانتداری و صداقت رعایت شده است.یافته‌ها: ولی نباید صغیره را به کمتر از مهرالمثل و یا صغیر را به بیشتر از آن، تزویج نماید، و اگر چنین کند، پس اگر مصلحتی باشد که چنین تزویجی را اقتضا کند، عقد و مهر هر دو صحیح است؛ ولی اگر مصلحت در خود تزویج باشد، نه در مهر، بنابر اقوى عقد صحیح و لازم است؛ به این معنی که مهر نافذ نیست و بعد از بلوغ، متوقف بر اجازه است.نتیجه: اقدام ولی نسبت به نکاح صغار باید در جهت غبطه و رعایت صلاح و سود آنان باشد، یا اینکه مستلزم مفسده و ضرر بر آنان نباشد، یعنی اگر ازدواج به مصلحت صغیر نباشد یا مضر به حال او باشد، این ازدواج نافذ نیست.

the observence of minor's expediency in financial relations resulting from marriage

background and purpose: the authority of father and paternal grandfather in the marriage of the boy and a girl is one of the fixed rules of jurisprudence. failure to respect the interest and expediency of the minor is in the conflict with  the great principles of jurisprudence.jurists believe that in marriage by guardian permission, the absence of corruption is enough. the purpose of  present research is to analyze the compilance of the minor expediency regarding financial relations resulting from marriage.materials and methods: the research method in present study is descriptive and analytical.ethical considerations:in present study, the authenticity of the text trustworthiness and honesty  have been observed.findings: however, it should not couple the  minor for less than the dowry or a minor for more than that, then if it is so and there is expediency that requires such a marriage ,both marriage and dowry are valid but if there is expedient in marriage not the dowery, it is clear that the marriage  is correct and necessary after puberty though  it is suspended on permission.results: the guardian's action regarding minor's marriage should be in the line with  the observance of expediency and minors benefits or should not involve corruption and harm to them, that is if the marriage is not in the interest of minor or is harmful to him ,the marriage is not valid.
