مقایسه قاعده تقلیل ثمن در کنوانسیون بیع بین المللی کالا با نهاد ارش و تقسیط ثمن در حقوق ایران

زمینه و هدف: وجود توازن در قراردادها، از دیرباز مورد توجه حقوقدانان ایران بوده است. هدف مقاله مقایسه قاعده تقلیل ثمن در کنوانسیون بیع بین‎المللی کالا با نهاد ارش و تقسیط ثمن در حقوق ایران است.مواد و روش‌ها: مقاله حاضر توصیفی تحلیلی است. مواد و داده‌ها نیز کیفی است و از فیش‌برداری در گردآوری مطالب و داده‌ها استفاده‌شده است.ملاحظات اخلاقی: در این مقاله، اصالت متون، صداقت و امانت‌داری رعایت شده است.یافته‌ها: یافته‌ها نشان داد، منشا قاعده تقلیل ثمن در ماده 50 کنوانسیون بیع بین‌المللی کالا، در حقوق روم است که بعد از آن مورد توجه بسیاری از حقوقدانان کشورهای دیگر قرار گرفته است. تحقیق و بررسی در منابع فقهی و حقوق مدنی ایران، عدم پذیرش ظاهری این قاعده را نشان می‌دهد ولی نهادهای مشابهی در قانون ایران وجود دارد که نشان دهنده امکان پذیرش این قاعده در حقوق ایران است.نتیجه: نهاد تقلیل ثمن در کنوانسیون مشابه نهاد ارش و مابه التفاوت در حقوق مدنی ایران است و از جهاتی بین این دو نهاد وجوه تشابه و از جهاتی بین آنها وجوه افتراق وجود دارد.

background and purpose: the existence of balance in contracts has long been the concern of iranian jurists. the purpose of the article is to compare the rule of price reduction in the convention on the international sale of goods with the institution of arash and the division of the price in iranian law.materials and methods: this article is descriptive and analytical. materials and data are also qualitative and data collection was used in collecting materials and data.ethical considerations: in this article, the originality of the texts, honesty and trustworthiness are respected.findings: the findings showed that the origin of the price reduction rule in article 50 of the convention on the international sale of goods is in roman law, which has been the focus of many jurists in other countries. research and investigation in jurisprudence and civil law sources of iran shows the apparent non-acceptance of this rule, but there are similar institutions in iranian law that indicate the possibility of accepting this rule in iranian law.conclusion: the institution of price reduction in the convention is similar to the institution of arsh and compensation for the difference in iran’s civil rights, and in some ways there are similarities between these two institutions and in some ways there are differences between them.
