بررسی فقهی حقوقی مسئولیت مدنی دولت در قبال خسارت ناشی از نوسانات شدید ارزی

زمینه و هدف: نوسانات ارزی در ایران در طی دو دهه اخیر بسیار شدید بوده و زندگی فعالان اقتصادی و عموم مردم را شدیداً تحت تاثیر قرار داده است. بر همین اساس هدف مقاله حاضر، بررسی بررسی فقهی حقوقی مسئولیت مدنی دولت در قبال خسارت ناشی از نوسانات شدید ارزی است.مواد و روش‌ها: مقاله حاضر توصیفی تحلیلی است. مواد و داده‌ها نیز کیفی است و از فیش‌برداری در گردآوری مطالب و داده‌ها استفاده‌شده است.ملاحظات اخلاقی: در این مقاله، اصالت متون، صداقت و امانت‌داری رعایت شده است.یافته‌ها: از منظر فقهی قواعدی چون قاعده لاضرر بیانگر مسئولیت مدنی دولت است هرچند قاعده احسان می‌تواند به معنای عدم مسئولیت دولت تعبیر شود. دولت به دلیل وظیفه نظارت بر کنترل ارز از یک سو و تاثیر شدید نوسانات ارز بر زندگی عموم جامعه از سوی دیگر، در برابر نوسانات ارزی در قبال جامعه مسئولیت مدنی دارد. مبانی مسئولیت مدنی دولت و دستگاه‌های نظارتی در نوسانات ارزی نظریه تقصیر، نظریه خطر و تضمین حق است. اما این تمام واقعیت نیست.نتیجه: نوسانات شدید ارز در ایران صرفاً تحت تاثیر سیاست‌های مالی و ارزی بانک مرکزی نیست. متغیرهای دیگر چون تحریم‌ها یکی از عوامل اصلی افزایش سریع و ناگهانی ارز محسوب می‌شود. بر همین اساس ایجاد رابطه سببیت میان دولت و خسارت ناشی از نوسانات ارز به سادگی میسر نیست. در ایران علیرغم پیش بینی برخی موقعیت‌های خاص در قوانین مصوب که مسئولیت دولت را منطبق با تئوری‌های تقصیر یا خطر پذیرفته است؛ در بسیاری از موارد با خلاء قانونی مواجه است

background and purpose: currency fluctuations in iran have been very severe, especially during the last two decades, and have severely affected the lives of economic activists and the general public. accordingly, the purpose of this article is to study the jurisprudential and legal study of the civil liability of the government for damages caused by severe currency fluctuations.materials and methods: this article is descriptive and analytical. the materials and data are also qualitative, and questionnaires were used to collect the materials and data.ethical considerations: in this article, the originality of the texts, honesty, and trustworthiness have been observed.findings: from a jurisprudential perspective, rules such as the rule of harmlessness indicate the civil liability of the government, although the rule of benevolence can be interpreted as the lack of government liability. the foundations of civil liability of the government and regulatory agencies in exchange rate fluctuations are the theory of fault, the theory of risk, and the guarantee of rights. but this is not the whole truth.conclusion: the sharp fluctuations in the exchange rate in iran are not solely influenced by the financial and exchange rate policies of the central bank. other variables such as sanctions are considered one of the main factors in the rapid in iran, despite the prediction of some specific situations in the approved laws that accept the responsibility of the government in accordance with the theories of fault or risk; in many cases, it faces legal problems or gaps.
