نظم عمومی و اخلاق حسنه اقتصادی از منظر منابع فقهی و حقوق ایران

زمینه و هدف: نظم عمومی و اخلاق حسنه دو مفهوم عام می باشند که در حوزه­های مختلف حقوقی از جمله قراردادها و ... دارای آثار مهمی می باشند. هدف از پژوهش حاضر بررسی و تبیین مفاهیم، اقسام، مصادیق، کارکردها و آثار نظم عمومی و اخلاق حسنه اقتصادی در نظام حقوقی ایران و فقه امامیه می باشد. مواد و روش ها: این تحقیق از نوع نظری بوده و ‌روش آن به صورت توصیفی تحلیلی می‏باشد و ابزار جمع ‏آوری اطلاعات نیز بصورت کتابخانه‏ ای است. یافته ها: یافته های پژوهش حاضر نشان می­دهد که، نظم عمومی اقتصادی و اخلاق حسنه اقتصادی در فضای نظام حقوقی ایران و فقه امامیه منبع اصول و قواعد محسوب می­شوند. در واقع، کارکرد این دو مفهوم، صرفاً یک کارکرد سلبی در جهت «نفی» نیست؛ بلکه این دو مفهوم می­توانند کارکرد ایجابی نیز داشته باشند. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانت­داری رعایت شده است.­­­­­نتیجه:  نظم عمومیِ اقتصادیِ منبع، با توجه به شاخصه متنی بودن آن، با قانون همان ابزار دولتی تطبیق پیدا می­کند، اما متفاوت از آن است، زیرا از یک سو مفاد همه مواد قانونی، جزء نظم عمومی اقتصادی تلقی نمی­شوند. اخلاق حسنه اقتصادیِ منبع، متنی نیست و همین نکته، کارکرد ایجابی آن را تاثیرگذارتر می­کند؛ منبعی که فراتر از متن، محل ظهور و کشف قواعد و اصول حقوقی است، هم خلا متنی را جبران می­کند و هم انعطاف پذیری نظام حقوقی و خروج آن از تصلب را نتیجه می­دهد.

public order and good economic ethics from the perspective of sources of jurisprudence and iranian laws

background and aim: public order and good morals are two general concepts that have important effects in various legal fields, including contracts, etc. the purpose of this research is to examine and explain the concepts, types, examples, functions and effects of public order and good economic ethics in iran’s legal system and imami jurisprudence.materials and methods: this research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles.ethical considerations: in order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed.results: the findings of the present research show that the general economic order and good economic ethics are considered the source of principles and rules in iran’s legal system and imami jurisprudence. in fact, the function of these two concepts is not merely a negative function in the direction of &negation rather, these two concepts can also have a positive functionconclusion: the general economic order of the source, due to its textuality, is compatible with the law - the same government tool - but it is different from it. because on the one hand, the provisions of all legal articles are not considered part of the general economic order. the good economic ethics of the source is not textual, and this point makes its positive function more effective; a source that is beyond the text, the place of emergence and discovery of legal rules and principles, compensates for the textual gap and results in the flexibility of the legal system and its exit from rigidity.
