بررسی ماهیت ریاست زوجه و تاثیر آن بر روابط اقتصادی خانواده

زمینه و هدف: خانواده یکی از نهادهای با اهمیت جامعه است. اجتماع بشری در طول تاریخ با تغییر و تحولاتی روبه رو شده است. و در پی آن نهاد خانواده که از جامعه اثر مستقیم می‌پذیرد، دچار این دگرگونی ها شده است. مواد و روش ها: این تحقیق از نوع نظری بوده ‌روش تحقیق به صورت توصیفی تحلیلی می‏باشد و روش جمع‏ آوری اطلاعات به صورت کتابخانه‏ ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانت داری رعایت شده است.یافته ها: از طرف دیگر قواعد و مقررات حقوق خانواده هم با تغییراتی همراه می شود. ماده 1105 قانون مدنی ریاست بر خانواده را به عهده زوج گذاشته است.نتیجه : چیستی ماهیت ریاست ذهن فقیهان و حقوق دانان را به خود مشغول کرده است که این حکم وضعی چگونه مورد جعل شارع قرار گرفته است و اگر جعلیت قانون گذار و شارع به آن تعلق نگرفته است، پس کاشف و موسس این نهاد از کجا الهام گرفته است.

background and aim: family stands for one of the key institutions of the society. over the history, human society has experienced changes and transformations; and consequently, directly affected by the society, the family institution has undergone these alterations. materials and methods: this research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles. ethical considerations: in order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed. result: on the other hand, the family law rules and regulations experience some changes. according to article 1105 of the civil code, the headship of the family is assigned to the husband. conclusion: what the nature of the headship is has occupied the minds of jurists and lawyers that how this declaratory law has been forged by the legislator and if it has not experienced the legislator and the lawyer’s forgery, then by where were this institution’s founder and discoverer inspired.
