سیاست جنایی مشارکتی اسلام در قبال جرائم اقتصادی

زمینه و هدف: اسلام همواره بر سیاست جنایی مشارکتی تاکیده داشته است در واقع نقش و جایگاه مردم و جامعه مدنی در عرصه علوم جنایی و واکنش به پدیده مجرمانه خاصه در قبال جرایم اقتصادی همواره متغیر بوده و در تاریخ عدالت کیفری نیز همین وضعیت را پشت سر گذاشته است.مواد و روش‌ها: این تحقیق از نوع نظری بوده ‌روش تحقیق به صورت توصیفی تحلیلی می‏باشد و روش جمع‏آوری اطلاعات بصورت کتابخانه‏ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.یافته‌ها: نقش و هدف اصلی سیاست جنایی در یک جامعه، کنترل موثر جرم و مهار پدیده‌های مجرمانه است. هدف از سیاست‌گذاری اقتصادی در حوزه اقتصاد مبارزه با فساد و جرایم اقتصادی است. دولت‌ها همواره در تلاش هستند تا با سیاست‌گذاری و اجرای برنامه‌های مختلف، خود را از نظر اقتصادی کارآمد کنند. زیرا آرامش و ثبات اقتصادی مهمترین و اساسی ترین مولفه امنیت محسوب می‌شود. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت محتوا، صداقت و امانت داری رعایت شده است.نتیجه‌گیری: فساد در نظام اقتصادی جرمی است که سال هاست محور سیاست‌های قانونگذاری ایران بوده است، اما شتابزدگی قانونگذار در تدوین قوانین مرتبط مانع از آن شده است که سیاست جنایی منسجم و قاطعی را در این زمینه دنبال کند. بنابراین موفقیت‌ در امر پیشگیری‌ از جرایم مرتبط با جرایم اقتصادی منوط به‌ مشارکت‌ تمامی‌ کنشگران جامعه‌ مدنی‌ است.

background and aim: islam has always emphasized participatory criminal policy. in fact, the role and position of people and civil society in the field of criminal science and response to criminal phenomena, especially economic crimes, has always been variable and the same situation in the history of criminal justice has laid.materials and methods: this research is of theoretical type. the research method is descriptive analytical and the method of data collection is library and has been done by referring to documents, books and articles.findings: the main role and purpose of criminal policy in a society is effective control of crime and curbing criminal phenomena. the purpose of economic policy in the field of economics is to fight corruption and economic crime. governments are always trying to be economically efficient by making policies and implementing various programs. because economic peace and stability is the most important and fundamental component of security.ethical considerations: in all stages of writing the present study, while respecting the originality of the content, honesty and trustworthiness have been observed.conclusion: corruption in the economic system is a crime that has been the focus of iranian legislative policies for many years, but the legislator’s haste in drafting related laws has prevented him from pursuing a coherent and decisive criminal policy in this regard. therefore, success in preventing economic crime related crimes depends on the participation of all civil society actors.
