وقف از نگاه فقه و حقوق موضوعه و تاثیر آن بر اقتصاد ایران

زمینه و هدف: یکی از موضوعات در عصر مدرن سنت وقف است. هدف آن پویا نمودن وقف درجامعه به عنوان میراثی ماندگار برای آیندگان در جامعه و کارکردهای اقتصادی زیادی همچون کاهش فقر می باشد. مواد و روش ها: شیوه روش تحقیق بصورت توصیفی تحلیلی و روش جمع آوری اطلاعات بصورت کتابخانه ای و با مراجعه به اسناد، کتب و مقالات می باشد.یافته ها: وقف از اعمال حقوقی، نیازمند به اراده و به دو دسته عقد و ایقاع تقسیم می شود و از حیث ماهیت حقوقی اختلاف در این است که: عقد است یا ایقاع؟ درباره مالکیت مال موقوفه، عده ای از فقها واقف را مالک، برخی عین موقوفه را متعلق به موقوف علیه / علیهم و بعضی هم خدا را مالک مال موقوفه می دانند. بنابراین؛ وقف، عقد است و حقوق مدنی ایران و فقه امامیه در خصوص وقف با هم اختلافی ندارند.ملاحظات اخلاقی:در تمام مراحل نگارش پژوهش، اصالت متون، صداقت و امانتداری رعایت شده است.نتیجه گیری: وقف از صدقات جاریه ، امور مستحبی و از مسائل جدید، وقف سهام و پول است که اولاً: با ادله قوی وقف مالیت (پول) را می پذیریم. ثانیاً: پذیرش شرط بقای اصل در موقوفه است. وقف پول دارای کارکردهای اقتصادی زیادی همچون کاهش فقر در جامعه، ایجاد اشتغال و سرمایه های بسیار در جامعه می باشد . برای اجرایی شدن وقف پول می توان از طریق بانک وقف پول، صندوق وقف قرض الحسنه و صندوق مشترک سرمایه گذاری وقف اقدام نمود.

background and aim: endowment is the topics in the modern era. its purpose dynamic endowment in society as a lasting legacy for the future in society and it has many economic functions, such as reducing poverty.materials and methods: the research method is descriptive analytical and the data collection method is library and by referring to documents, books and articles.findings: endowment is from legal acts; it requires willpower and is divided into two categories of contract and agreement and legally there is a difference: is it a contract or an agreement? about the ownership of the endowment property, some jurists know dedicator the owner, some of the same endowment belongs to the recipient of the endowment and some make god the owner of the endowment. thus; endowment is a contract and there is no difference between iranian civil law and jurisprudence.ethical considerations: have been observed in all stages of research writing, originality of texts, honesty and trustworthiness.conclusion: is endowed from current charity, recommended matters and one of the new issues is the endowment of stocks and money that; first: we accept the endowment of tax (money) with strong arguments. secondly: acceptance is the main condition in the endowment. it has many economic functions such as reducing poverty in society, creating employment and a lot of capital in society. to implement it, can be done through loan funds and mutual funds.
