تاثیر اشرافی‌گری بر عدالت اقتصادی در پرتو فقه و قانون اساسی

زمینه و هدف: اشرافی‌گری از معضلات مبتلا به در جامعه است که پیامدهای مختلفی به دنبال دارد. در این مقاله تلاش شده است تاثیر اشرافی‌گری بر عدالت اقتصادی در پرتو فقه و قانون اساسی بررسی شود.مواد و روش‌ها: در مقاله حاضر برای گردآوری اطلاعات، از روش کتاب خانه‌ای و برای تحلیل یافته ها از روش توصیفی-تحلیلی استفاده شد.ملاحظات اخلاقی: در این مقاله، اصالت متون، صداقت و امانت‌داری رعایت شده است.یافته‌ها: یافته‌ها بر این امر دلالت دارد که عدالت اقتصادی در فقه و قانون اساسی به‌صورت عدالت تخصیصی و عدالت توزیعی مورد توجه و تاکید قرارگرفته است و اشرافی‌گری(که در فقه از آن در قالب مفاهیمی چون اتراف و تکاثر بحث شده است) مذموم و بر عدم تحقق عدالت اقتصادی تاثیرگذار است. اشرافی‌گری با تاثیر بر توزیع ناعادلانه امکانات، دامن زدن به فقر، انحصارگرایی، رانت و احتکار، اختلاس و دست‌اندازی به بیت‌المال موجب بی‌عدالتی‌ اقتصادی می‌شود. اشرافی‌گری وضعیتی را ایجاد می‌کند که طی آن، کسب ثروت در راستای زندگی تجملی به هر طریق ممکن از جمله توزیع ناعادلانه امکانات، اختلاس و رانت به هدف اصلی تبدیل می‌شود. این امر مغایر با آموزه‌های دینی و سیره به‌ویژه سیره حضرت علی و اصول قانون اساسی است که بر رعایت عدالت اقتصادی تاکید دارد.نتیجه‌گیری: مهم‌ترین راهکار مقابله با اشرافی‌گری و درنتیجه تحقق عدالت اقتصادی، توزیع عادلانه امکانات و فرصت‌ها و مقابله با ویژه خواری و دست‌اندازی به بیت‌المال است.

background and aim: aristocracy is one of the problems in society, which is followed by various consequences. in this paper, the effect of aristocracy on economic justice in the light of jurisprudence and the constitution is investigated.materials methods: this paper is descriptive-analytical and library method is used.ethical considerations: in this paper, the originality of the texts, honesty, and trustworthiness are observed.findings: the findings indicate that economic justice has been emphasized and taken into consideration in jurisprudence and the constitution in the form of allocative justice and distributive justice, and aristocracy, which is discussed in jurisprudence in the form of concepts such as luxury and acquisitiveness, is reprehensible and affects the non-realization of economic justice. aristocracy leads to economic injustice by affecting the unfair distribution of facilities, fueling poverty, exclusivity, rent and hoarding, embezzlement, and tampering with the bait-al-mal (public treasury). aristocracy creates a situation in which the main goal is to acquire wealth in order to live a luxurious life in any possible way, including unfair distribution of facilities, embezzlement, and rent. this is contrary to religious teachings and life, especially the life of imam ali (as) and the principles of the constitution, which emphasizes economic justice.conclusion: the most important way to tackle aristocracy and consequently to achieve economic justice is to distribute facilities and opportunities fairly and to deal with rent-seeking and tampering with public treasury.
