مبانی فقهی سیاستگذاری کیفری در حوزه اقتصاد

زمینه و هدف: سیاست گذاری کیفری در هر نظام سیاسی تحت تاثیر مبانی پذیرفته شده در آن جامعه است که در عرصه اقتصاد نیز متجلی می شود. هدف پژوهش حاضر، بررسی مبانی فقهی سیاست گذاری کیفری در حوزه اقتصاد است. مواد و روش‌ها: مقاله ی حاضر از نوع نظری و روش تحقیق آن توصیفی - تحلیلی می باشد و شیوه ی گردآوری اطلاعات کتابخانه ای با بهره گیری از منابع فقهی و حقوقی است. ملاحظات اخلاقی: پژوهش حاضر اصل اخلاقی امانت داری در منابع و مراجعه به منابع را مبنای پژوهش قرار داده است. یافته‌ها: مبانی فقهی سیاست گذاری کیفری در حوزه اقتصاد بر مبنای حرمت اکل مال به باطل، حفظ نظم و امنیت در جامعه اسلامی، حرمت تعاون بر اثم، قاعده لاضرر، توزیع منصفانه ثروت و جلوگیری از کسب نامشروع اموال  بنا می شود. نتیجه‌: سامان بخشی به حوزه اقتصاد نیازمند سیاست گذاری کیفری مبتنی بر قواعد فقهی است که بتواند عدالت و ارزش های انسانی و اسلامی را در جامعه برقرار نموده و مجازات خاصی را نیز برای اخلال گران اقتصادی در نظر بگیرد. جلوگیری از کسب ثروت نامشروع، ایجاد قوانینی برای دسترسی همگان به ثروت ها و منابع اقتصادی و اجتماعی بخش مهمی از سیاست گذاری کیفری در حوزه اقتصاد با ابتناء به قواعد فقهی هستند

background and aim: criminal policy in any political system is influenced by the accepted principles in that society, which is also manifested in the field of economics. the purpose of this study is to investigate the jurisprudential principles of criminal policy in the field of economics.materials and methods: the method of this article is descriptive-analytical and utilizing library resources including jurisprudential and legal resources.ethical considerations: the present study is based on the ethical principle of fidelity to resources and reference to first-hand sources.results: the jurisprudential principles of criminal policy in the field of economics are based on the sanctity of false property, maintaining order and security in islamic society, sanctifying cooperatives on sin, harmless rule, fair distribution of wealth and preventing the illicit acquisition of property.conclusion: organizing the field of economics requires criminal policy based on jurisprudential rules that can establish justice and human and islamic values in society and consider special punishments for economic disruptors. preventing the acquisition of illegitimate wealth, creating laws for public access to wealth and economic and social resources are an important part of criminal policy in the field of economics based on jurisprudential rules.
