کارکرد عنصر مال و تاثیر آن بر اقتصاد با رویکرد فقهی-حقوقی

زمینه و هدف: قانون گذاران نیز در جوامع مختلف با اتکا بر معیارهای مختلفی سعی در حمایت از دارایی و اموال شهروندان داشته اند تا منافع آنها به شکل مناسب تری تامین گردد، یکی از این معیارها، معیار اقتصادی می باشد، الهام گیری و ارائه نگاه اقتصادی در ارتباط با اموال، آثار متنوعی را به همراه خواهد داشت و دیدگاه های جدیدی را خلق می نماید که در پژوهش حاضر به این مهم پرداخته خواهد شد. مواد و روش‌ها: این تحقیق از نوع نظری بوده ‌روش تحقیق به صورت توصیفی تحلیلی می‏باشد و روش جمع‏آوری اطلاعات بصورت کتابخانه‏ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانت داری رعایت شده است. یافته‌ها: اساساً صرف اینکه شیء در معرض مبادله قرار بگیرد و افراد در مقابل آن بهایی بپردازند، آن را واجد ارزش مال می نماید و اساساً هر چیزی که به ازای آن مالی داده شود، مال نامیده می شود. عرف نیز چنین مواردی را مال تلقی نموده و برای آن مالیت و ارزش اقتصادی قائل شده است. مالکیت نیز بیانگر رابطه ای می باشد که بین شخص و شیء مادی قرار گرفته و قانون نیز آن را معتبر می شناسد و به مالک این اجازه را می دهد که نهایت انتفاع را از آن مال ببرد و کسی نتواند از آن جلوگیری نماید. نتیجه‌: رویکرد اقتصادی به عنصر مال این امر را اثبات می نامید که با توجه به تحولات حوزه ی اقتصاد باید برای «مال» قلمداد کردن هر چیز، منافع آن در جامعه و نحوه ی برخورد عرف با آن را در نظر بگیریم.

the function of property element and it’s effect on the economy based on a jurisprudential-legal approach

background and aim: legislators in different societies, relying on different criteria, have tried to protect the property and assets of citizens to better serve their interests. one of these criteria is the economic criterion, inspiring and providing an economic perspective on property will have a variety of effects and create new perspectives that will be addressed in this study.materials and methods: this research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles.ethical considerations: in order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed.results: basically, just because an object is traded and people pay a price for it, it makes the property worthwhile, and basically anything that is paid for is called property. custom has also considered such cases as property and has given them tax and economic value. ownership also refers to the relationship that exists between a person and a material object, and the law recognizes it as valid and allows the owner to take full advantage of that property and no one can prevent it.conclusion: the economic approach to the element of property proves that in view of the developments in the field of economics, in order to consider everything as &property&, we must consider its interests in society and the way in which custom deals with it.
