مبانی فقهی تعهدات دولت در تامین کالاها و خدمات عمومی در نظام حقوقی ایران

زمینه و هدف: دولت به مفهوم نوین آن متعهد به تامین کالا و خدمات موردنیاز شهروندان است. مبنای تعهدات دولت در این خصوص از موضوعات محل بحث و نظر بوده است. در این مقاله تلاش شده مبانی فقهی تعهدات دولت در تامین کالاها و خدمات عمومی در نظام حقوقی ایران بررسی شود.مواد و روش‌ها: نوع تحقیق، توصیفی تحلیلی بوده و از روش کتابخانه‌ای و از فیش‌برداری برای گردآوری اطلاعات استفاده‌ شده است.ملاحظات اخلاقی: در این مقاله، اصالت متون، صداقت و امانت‌داری رعایت شده است.یافته‌ها: در آموزه‌های فقهی، تامین کالا و خدمات مورد نیاز شهروندان و در کل خدمت‌رسانی به مردم یک ارزش محسوب می‌شود. منابع فقهی تعهدات دولت در این خصوص، آیات و روایات و سیره معصومین  است که مطابق آن ها بر ضرورت تامین کالاها و ارائه خدمات عمومی از سوی حکومت اسلامی تاکید شده است.نتیجه‌گیری: دولت به منظور انجام تعهدات خود در زمینه تامین کالا و خدمات عمومی به مردم، نیازمند سازوکارهایی است: دخالت در تنظیم بازار از مهم ترین سازوکارهای تحقق تعهدات دولت در این زمینه است. دخالت دولت به عنوان عامل تنظیم از طریق مبارزه با احتکار کالا و گران فروشی کالا و خدمات سبب می‌شود، کالا و خدمات با شرایط مناسب در اختیار مردم قرار گیرد. علاوه بر این، سلامت اداری و مبارزه با فساد و در همین حال، وجود نظارت کارآمد از سوی دولت، از عوامل مهم ارایه خدمات عمومی مطلوب به مردم است.

background and aim: the government is committed to providing goods and services needed by citizens to its new concept. the basis of the government’s commitments in this regard has been the subject of debate. in this article, an attempt has been made to examine the jurisprudential foundations of the government’s obligations in providing public goods and services in the iranian legal system.materials and methods: this article is a descriptive-analytical and library method has been used.ethical considerations: in this article, the originality of the texts, honesty and trustworthiness have been observed.findings: in jurisprudential teachings, providing goods and services needed by citizens and serving the people in general is considered a value. the jurisprudential sourcees of the government’s obligations in this regard is several verses and hadiths in which the necessity of providing goods and providing public services by the islamic government is emphasized.conclusion: in order to fulfill its obligations in the field of providing public goods and services to the people, the government mechanisms needs: interference in market regulation is one of the most important mechanisms for fulfilling the government’s obligations in this field. government intervention as a regulatory factor through the fight against hoarding of goods and the overselling of goods and services causes goods and services to be made available to the people on appropriate terms. in addition, administrative health and the fight against corruption, as well as the existence of effective oversight by the government, are important factors in providing desirable public services to the people.
