مفهوم کار شایسته در ارتقاء اقتصاد با نگاهی به منابع فقهی

زمینه و هدف: کار شایسته از مقولات مهم حقوق کار است که از منظر فقهی و اقتصادی چندان مورد توجه قرار نگرفته و در این مقاله تلاش شده، ضمن بررسی مولفه ها و عناصر آن، رویکرد فقه در این خصوص و نقش آن در ارتقاء اقتصادی تبیین و تحلیل شود.مواد و روش‌ها: مقاله توصیفی - تحلیلی بوده و از روش کتابخانه‌ای استفاده شده است.ملاحظات اخلاقی: در این مقاله، اصالت متون، صداقت و امانت‌داری رعایت شده است.یافته‌ها: کار شایسته، کاری مولد مبتنی بر کرامت انسانی است که از دو منظر حقوق بشر و توسعه انسانی تبیین شده است. ممنوعیت کار کودکان و حداقل سن کار، لغو کار اجباری، آزادی انجمن‌ها و حمایت از حق تشکل ها، مذاکره جمعی، حمایت از اشتغال، حمایت و تامین اجتماعی و در کل موازنه بین زندگی کاری و زندگی شخصی ازجمله شاخصه‌های کار شایسته است مولفه های مورد اشاره در فقه اسلام نیز تا حد زیادی مورد توجه و تاکید قرار گرفته است.نتیجه‌: کار شایسته مفهومی چند بعدی است که علاوه بر کمیت اشتغال به کیفیت آن نیز می‌پردازد و در نتیجه نه تنها به کار بیشتر بلکه به کار بهتر نیز توجه دارد. کار شایسته از ارکان توسعه پایدار و رشد همه جانبه ملت‌ها است که از طریق حمایت از اشتغال و کار مولد، ایجاد حس تعهد، مسئولیت پذیری و انگیزه، کاهش فقر و افزایش بهره وری، توجه به نیروی کار زنان در ارتقاء اقتصاد تاثیرگذار است.

background and aim: decent work is one of the important categories of labor law that has not been considered much from a jurisprudential and economic point of view. in this article, while examining the components of decent work, the jurisprudential point of view in this regard and its role in economic promotion is explained and analyzed.materials and methods: this article is analytical descriptive and uses the library method.ethical considerations: in this article, originality of texts, honesty and trusteeship has been complied with.results: decent work is explained on the basis of human dignity in terms of both human rights and human development. abolition of forced labor, freedom of association, prohibition of child labor and minimum working age, collective bargaining, employment protection, protection and social security are among the characteristics of decent work. the components mentioned in islamic jurisprudence have also been greatly emphasized.conclusion: decent work is a multidimensional concept that, in addition to the quantity of employment, also pays attention to its quality, and as a result, to better work pays attention. decent work is one of the pillars of sustainable development and all-round growth of nations, which in promoting the economy by supporting employment and productive work, creating a sense of commitment, responsibility and motivation, reducing poverty and increasing productivity, paying attention to women’s labor force is effective.
