تاثیر رانت خواری بر اقتصاد با رویکرد فقهی

زمینه و هدف: رانت خواری یکی از جلوه های فساد است که آثار آن در حوزه اقتصاد بسیار قابل توجه است. پژوهش حاضر درصدد است تا به بررسی تاثیر رانت خواری بر اقتصاد از منظر فقهی بپردازد.مواد و روش‌ها: روش مورد استفاده در پژوهش حاضر، تحلیل محتوای کیفری و مراجعه به متون فقهی، اسناد حقوقی، مقالات و تحقیقات نگاشته شده در این زمینه است.ملاحظات اخلاقی: پژوهش حاضر با مبنا قرار دادن اصول اخلاقی در ارجاع دهی و استفاده از منابع فقهی و متون دست اول نگارش شده است.یافته‌ها: رانت خواری دارای انواعی از رانت اطلاعاتی، اقتصادی، سیاسی، اجتماعی، آموزشی، قضایی و امنیتی است و به دلیل دسترسی ایجاد کردن برای عده ای و محروم ماندن عده ای دیگر، از مظاهر ظلم و فساد است. در فقه، رانت خواری عملی قبیح و حرام اعلام شده است.نتیجه‌: شکوفایی اقتصادی نیازمند کار و تلاش مولد و دوری از روش هایی است که باعث دسترسی عده ای به منافع و محروم ماندن عده ای دیگر شود. از این جهت، رانت باعث نابرابری، ظلم و ستم و همچنین شکل گیری باندهای مافیایی ثروت و قدرت می شود. فقه اسلامی مخالف ثروت اندوزی نامشروع از جمله رانت خواری است.

background and aim: rent-seeking is one of the manifestations of corruption, the effects of which are very significant in the field of economics. the present study seeks to investigate the effect of rent-seeking on economics from a jurisprudential perspective.materials and methods: the method used in the present study is the analysis of criminal content and reference to jurisprudential texts, legal documents, articles and research written in this field.ethical considerations: the present study has been written based on ethical principles in referring to and using jurisprudential sources and first-hand texts.results: bribery has a variety of information, economic, political, social, educational, judicial and security rents and is a manifestation of oppression and corruption due to providing access to some and depriving others. in jurisprudence, practical rent-seeking has been declared ugly and forbidden.conclusion: economic prosperity requires productive work and effort and avoidance of methods that allow some to access the benefits and deprive others. for this reason, rent causes inequality, oppression, as well as the formation of mafia gangs of wealth and power. islamic jurisprudence opposes illegitimate amassing wealth, including rent-seeking.
