سیاست جنایی ایران درجرایم اقتصادی

زمینه و هدف: اقتصاد در زندگی افراد جامعه، نقش بی بدیلی را ایفا می کند و به دلیل برخورد مستقیم با زندگی مردم، اساسی بوده و به هیچ عنوان نمی توان آن را نادیده گرفت؛ به نحوی که به نقل از معصومین، نابسامانی در حوزه اقتصاد نه تنها باعث اخلال در حوزه های دیگر زندگی می شود بلکه دین و معاد انسان را نیز تحت تاثیر خود قرار می دهد. هدف ما در این تحقیق تبیین سیاست جنایی ایران در مواجهه با جرایم اقتصادی از منظر حقوق موضوعه می باشد.مواد و روش‌ها: مقاله حاضر به شیوه توصیفی - تحلیلی و ابزار تحقیق، فیش برداری از منابع کتابخانه ای می باشد.ملاحظات اخلاقی: از ابتدا تا انتهای مقاله اصول صداقت و امانت داری رعایت گردیده است.یافته‌ها: برقراری و حفظ نظم اقتصادی در گرو مبارزه با اخلال گران در نظام اقتصادی و مجرمین اقتصادی است. مبارزه با جرایم اقتصادی هم موجب برقراری نظم اقتصادی می شود و هم از آثار و تبعات مضر اختلال در اقتصاد کشور جلوگیری می کند.نتیجه‌: سیاست جنایی ایران در قبال جرائم اقتصادی با چالش های عدیده ای مواجه می باشد. از اساسی ترین این چالش ها و ابهامات می­توان به عدم تبیین جامع و مانع از مفهوم و هدف جرایم اقتصادی، گستره پرونده ها، نحوه اتخاذ سیاست کیفری و میزان تناسب و اثربخشی آن اشاره نمود.

background and aim: the economy in the lives of the people of society plays an alternative role and cannot be ignored because of direct contact with the lives of the people, and cannot be ignored in any way, but also affected the religion and the resurrection of man. the aim of this study is to explain the criminal policy of iran in the face of economic crimes from the perspective.materials and methods: the present paper is descriptive - analytical and the research tool is one of the library sources.ethical considerations: from the beginning to the end of the article, the principles of integrity and fiduciary duties have been established.results: the establishment and maintenance of economic order in the fight against sabotage in the economic system and economic offenders is economic. the fight against economic crimes also causes economic order and prevents harmful effects of disturbance in the countrys economy.conclusion: the criminal policy of iran faces many challenges in the face of economic crimes. the most basic of these challenges and uncertainty can be pointed to the lack of comprehensive explanation of the concept and purpose of economic crimes, the extent of the cases, the way of adopting criminal policy and the degree of its suitability and effectiveness.
