نقش عرف در تعیین حقوق مالی زوجین از منظر فقه امامیه

زمینه و هدف: حقوق مالی زوجین از عرف و شرایطی که زوجین در آن زندگی می‌کنند، اثر می‌پذیرد. بر همین اساس، هدف پژوهش حاضر نیز بررسی جایگاه عرف در تعیین حقوق مالی زوجین از منظر فقه امامیه است. مواد و روش‌ها: برای بررسی موضوع حاضر از روش توصیفی و تحلیلی و با تکیه بر اسناد و منابع فقهی و حقوقی اسلامی بهره برده شد. یافته‌ها: بنای زندگی مشترک با ابتناء بر محبت، تعاون و از خود گذشتگی است. برای دستیابی به این معیارهای اصیل و بنیادین نیازمند در نظر گرفتن تحولات و تغییرات در حقوق، تکالیف و به تبع آن نظام حقوقی در جامعه اسلامی هستیم که از آن با عنوان عرف یاد می‌شود. ملاحظات اخلاقی: انجام پژوهش حاضر با در نظر گرفتن ملاحظات اخلاقی از جمله دقت در منابع و ارجاع دهی علمی میسر شده است. نتیجه گیری: مبنا قرار دادن عرف به معنای اهمیت تنظیم حقوق و تکالیف در نظام خانواده، توجه به شرایط زمانی و مکانی، خارج نشدن از معیارهای فراگیر شریعت اسلامی و تقدم قداست نظام خانواده و زندگی زوجین بر امور فرعی است.

background and aim: the financial rights of the couple are affected by the customs and conditions in which the couple lives. accordingly, the purpose of this study is to examine the position of custom in determining the financial rights of couples from the perspective of imami jurisprudence.materials and methods: to investigate the present issue, a descriptive and analytical method was used, relying on islamic jurisprudential and legal documents and sources.ethical considerations: the present study has been made possible by considering ethical considerations such as accuracy in sources and scientific references.results: building a life together based on love, cooperation and self-sacrifice. in order to achieve these original and fundamental criteria, we need to consider the changes and changes in law, duties, and consequently the legal system in islamic society, which is called custom.conclusion: establishing custom means the importance of regulating rights and duties in the family system, paying attention to temporal and spatial conditions, not going beyond the universal standards of islamic law, and prioritizing the sanctity of the family system and the couple’s life over minor matters.
