مبانی معرفت شناختی حقوق غرب از طلیعه فلسفه تا کانت

موضوع معرفت شناسی، و یا نظریه دانش، ذهن انسان را برای هزاران سال به خود مشغول کرده است. موارد بسیاری در مورد آن نوشته شده است، و راههای بسیاری برای مطالعه آن وجود دارد. می توان گفت که این مساله به عنوان یک مقوله فلسفی در غرب، توسط افلاطون آغاز شده و بعدها توسط ارسطو، شاگرد افلاطون، بعدها بوسیله دیگر فیلسوفان عصر روشنگری همچون هابز، دکارت، لاک، هیوم و در ادامه تاریخ تفکر غرب توسط کانت، توسعه یافته است. این پژوهش دامنه دار فلسفی هیچ یک از جنبه های دانش بشری را از حیطه ی خود خارج ندانسته و با طرح مسایل بنیادین خود در هر شاخه از دانش بشری تلاش کرده است تا با ضابطه هایی که ارائه شده است میزان صدق و باور پذیری دستاورد های آن دانش را مشخص نماید . در دانش حقوق مسایلی از این دست که: پایه های اصلی دانش حقوق کدامند؟ از جمله مهم ترین این سوالات است. البته این سوال را می توان به گونه ای عام تر نیز طرح نمود: چگونه می توان با دستیابی به درک معرفت شناختی فهم درستی از نظریات حقوقی داشت؟ در این مفهوم، معرفت شناسی به دنبال شناسایی اصولی برای ارزیابی نظریه های حقوقی است. این پژوهش بر آن است که دریک نگرش تاریخی- فلسفی در زمینه تئوری حقوقی تاثیر انگاره های معرفت شناسانه را در قطعه ی مهمی از تاریخ تفکر بشری ( دوران نضج گیری فلسفه در یونان تا ظهور کانت) بررسی نماید.

epistemological foundations in western law from the beginning of philosophy to kant

the issue of epistemology or theory of knowledge has preoccupied human mind for thousands of years. numerous works have been authored regarding it and there are several ways for studying it. one can state that this issue, as a philosophical category, has begun by plato in the west and later by plato’s pupil aristotle and many contributions have been made to it by the philosophers of the age of enlightenment like hobbes, descartes, locke, hume and in the history of western thought, it has been developed by kant. this extensive philosophical study has not left any aspects of human knowledge outside itself and by raising fundamental issues in each branch of human knowledge, it has sought to determine the scale of truth of the achievements of this knowledge by the means of the provided measures. in the science of law questions, the following are among the most important questions: what are the basic foundations of law? this question can be raised in a more general way: how can we reach a correct understanding of legal theories via an epistemological conception? thus conceived, epistemology seeks after identification of principles for evaluation of legal theories. the current study was an effort for studying the the influence of epistemological notions in an important part of the history of human thinking (from the age of formation of philosophy in greece to the emergence of kant) based on a historical and philosophical persecptive of legal theory.
