بررسی تطبیقی الگوی ایرانی صیانت از کودکان و نوجوانان در فضای مجازی و استانداردهای حقوق بین الملل کودک

سند صیانت از کودکان و نوجوانان در فضای مجازی مصوب شورای عالی فضای مجازی خالق الگوی ملی برای نظم بخشی حقوقی و مدیریت فضای مجازی در ارتباط با کودکان و نوجوانان ایرانی است. جوهر این سند، ایجاد محیط مجازی صیانت شده برای کودکان و نوجوانان است. این مهم با توسعه محتوای منطبق با نیازهای ویژه کودکان و نوجوانان، خدمات مجازی رده بندی شده، استقرار نظام حمایت و پایش، فرهنگ سازی، ارتقای دانش مجازی و تعاملات بین المللی محقق میشود. کمیته حقوق کودک در تفسیر کلی شماره 25 ضمن ارائه چارچوبی راهنما برای صیانت از کودکان در فضای مجازی، به صیانت از مصالح عالیه کودک در فضای مجازی اصالت بخشیده است. منع تبعیض، صیانت از مصالح عالیه کودک و توجه به دیدگاههای وی محتوای این الگو، و سیاستگذاری ملی، همکاریهای ملی و بین المللی، تخصیص منابع، ارزیابی اثرات مجازی، دانش افزایی مجازی، پایش، تمهید دادخواهی و جبران خسارت راهکار تحقق این مهم است. پژوهش حاضر بدنبال ارزیابی و تطبیق الگوی ترسیم شده در سند صیانت با استانداردهای بین المللی حقوق کودک است. این پژوهش با استفاده از روش توصیفی- تحلیلی و به شیوه ای تطبیقی نشان می‌دهد که الگوی سند صیانت با اولویت بخشی به ملاحظات ملی و فرهنگی و تلاش برای توسعه محیط های صیانت شده بر بستر شبکه ملی اطلاعات در صدد ترسیم چارچوبی حقوقی مستقل اما مرتبط با تعهدات بین المللی جمهوری اسلامی ایران است. این الگو علیرغم همپوشانی هنجاری و محتوایی در برخی مواضع، به تمامه قابل انطباق با استانداردهای بین المللی حقوق کودک بنظر نمی رسد و لازم است در نظم بخشی های آتی و از جمله تقنین عادی، التزام به هنجارهای بین المللی حقوق کودک و حمایت از حقوق ماهوی کودک به روشنی منعکس شود .

the document for the protection of children and adolescents in cyberspace creates a national model for legal regulation and management of cyberspaceregarding iranian children and adolescents. the spirit of this document, which isprotectionism, is realized through creating a protected virtual environment forchildren and teenagers. the realization of this importance is through thedevelopment of content that meets the special needs of children and teenagers,classifying cyber services, the establishment of a support and monitoring system,and cultivating and promoting cyber knowledge and international interactions.in general comment no. 25, by introducing a guiding framework for theprotection of children in cyberspace, the committee on rights of the child (crc)has given authenticity to the protection of the best interests of the child incyberspace. the content of this model includes the obligation to eliminate allforms of discrimination against children, protection of the child's best interestsand attention to his views, and national policy making, national and internationalcooperation, allocation of resources, evaluation of virtual effects, virtualknowledge enhancement, monitoring, preparation for litigation. andcompensation is the solution to realize this important. this research using thedescriptive-analytical method and in a comparative way shows that the model ofprotection document with priority given to national considerations includingcultural-islamic values and efforts to develop a protected virtual environment onthe basis of the national information network and (not international information network) aims to draw an independent legal framework but related to theinternational obligations of the islamic republic of iran.
