بررسی نظام حقوقی رای داوری بازرگانی بین‌المللی: مطالعه تطبیقی حقوق ایران و قواعد داوری آنسیترال

موضوع این تحقیق بازشناسی رای از سایر تصمیمات داوری و نیز بررسی مراحل انشاء، ابلاغ و آثار رای در نظام داوری بازرگانی بین‌المللی ایران و قواعد داوری آنسیترال است. ازآنجاکه دیوان داوری در طول داوری تصمیمات مختلفی اتخاذ می‌کند و نیز به دلیل آن‌که آثار حقوقی رای از سایر تصمیمات متفاوت و متمایز است لذا شناخت نظام حقوقی رای داوری امری ضروری است. نظر به این‌که قانون داوری تجاری بین‌المللی ایران از قانون نمونه آنسیترال اقتباس‌شده و این قانون در تنظیم بسیاری از مواد خود از قواعد داوری آنسیترال الهام گرفته است و از آن‌جاکه علاوه بر تفاوت دادرسی قضایی و داوری در خصوص نظام حقوقی حاکم بر صدور رای؛ انواع و آثار آن، فی‌مابین مقررات داوری تدوین‌شده در این خصوص، در کنار شباهت زیاد، تفاوت نیز وجود دارد. در این نوشتار سعی بر شناخت وجوه افتراق و اشتراک رای داوری در قانون داوری تجاری ایران و قواعد داوری آنسیترال شده است؛ ازاین‌رو در این مقاله که به روش تحلیلی-توصیفی نگاشته شده است نگارندگان تلاش نموده‌اند معیار تشخیص رای از سایر تصمیمات اتخاذی و نیز انشاء، اعلام و آثار آن را یکی پس از دیگری موردمطالعه قرار داده و سپس پیشنهاد‌هایی جهت اصلاح قانون داوری تجاری بین‌المللی ایران ارائه دهند.

considration and analysis of legal system of awards in international commercial arbitration: a comparative study of iranian law and the uncitral arbitration rules

the question and subject of this paper is, recognition the award from other kinds of arbitral decisions and also consider the writing, communicating and impacts of award in international commercial arbitration system of iran and uncitral arbitration rules. since, arbitral tribunal during the process of arbitration, issues various types of decisions, also because of the legal effects of award is different and distinguished from other ones, so recognition the legal system of arbitratal award is necessary. regarding this matter that the international commercial arbitration act of iran and its regulations are adapted from uncitral model law and also their differences between judicial and arbitral procedures which govern on legal system of issuing award, different types and its impacts, between arbitral regulations which have been ratified in this regard, it can be said that even though these two acts have lots of similarities, there are significant differences between them too. the purpose of this paper is to find the existing similarities and differences of international commercial arbitration act of iran and the rules of the uncitral arbitration. in this article which has been written in descriptiveanalytic method, the authors try to find the criterion of identifying an award from other decisions, its writhing and communicating respectively. then some suggestions will be submit in order to amendment of international commercial arbitration act of iran
