بررسی جایگاه حقوقی شورای امنیت و حدود اختیارات و صلاحیت آن

شورای امنیت یکی از ارگان های سازمان ملل متحد است که وظیفه پاسداری از صلح و امنیت بین المللی را به عهده دارد. این اهمیت بدان دلیل است که شورای امنیت قادر است، تصمیمات لازم الاجرایی در چارچوب منشور ملل متحد اخذ و تمامی دول عضو را متعهد به اجرای آن نماید. با بررسی عملکرد شورای امنیت درمی یابیم که هرچند شورا، ظاهراً در حدود اختیارات و ساختار موجود عمل کرده است، ولی از رویکرد کلّی قطعنامه های شورا، این امرآشکار میشود که شورا اگرچه در جهت اهداف منشور عمل کرده است ولی گاهی به علّت فقدان تعاریف دقیق از مفاهیم کلیدی مانند صلح وامنیت و تجاوز و مفاهیم حقوق بشردوستانه، حقوق بشر و تروریسم، دامنه و حدود اختیارات شورا با ابهامات و سوء برداشت هایی همراه بوده است. از این رو، حیطه ی صلاحیت شورای امنیت، فصول شش و هفت و هشت و دوازده منشور و شرایط مذکور در ماده ی 24 و اختیارات ضمنی شورا در چهارچوب اصول و اهداف منشور است، که شورا در اجرای آن گاهی با چالشهایی مواجه بوده است. بررسی حیطه اختیارات و صلاحیت های شورای امنیت با رویکردی جدید می تواند باعث تقویت نقش شورای امنیت و افزایش کارایی شورا در ایفای وظایف خویش باشد.

the review of the legal status of security council and its powers and competence

the secunty council is organ of the united notions organization which has the duty to safegard from intenational peace and secunty. this importance is rooted in the fact that the secunty council is able to take enforceable actions in the fame work of united nations organization and all member are obliged to enforce them. with reviewing the function of security council we understand that although the council apparently acted within the existing powers and structres ,but from the council qeneral resolution approach it is clear that the council acted in the direction of cherter purpose, due to the lack of strict defenitions of the key concepts like peace , security , aggression and humanitarian concepts terrorisem, sometimes the council powers have been associated with ambugity and misunderstanding there fore, the scope of the security council competence are the chaptee six, seven , eight , twelve and mentioned conditions in article 24 and implied powers of the council in the framework of chartee principles and purposes, therefore the council in its enforamet encountered with some challenges. the review of the scope of council,s powers and competences with a new approach may strength the role of the secunty council and increase it,s ability in performance of the functions.
