معیارهای انتساب اعمال شورشیان به دولت در حقوق بین الملل

در حقوق بین الملل طبق قاعده ی کلی رفتار شورشیان سازمان یافته به دولت منتسب نمی شود؛ زیرا آنها ارگان دولت محسوب نمی شوند و نیز دولت در موقعیتی نیست که کنترل موثری بر فعالیت های آنها داشته باشد. اما موقعیت هایی وجود دارد که رفتار شورشیان میتواند به کشوری که در قلمرو آن فعالیت می کنند و یا به کشور دیگر منتسب شود. حالت اول، زمانی است که دولت در مظان اتهام همکاری و یا ترک فعل در برابر اعمال زیانبار شورشیان قرار گیرد. حالت دوم، هنگامی است که شورشیان طبق دستورالعمل و یا تحت هدایت و یا کنترل کشور دیگر عمل کنند که در این صورت ارگان بالفعل (de facto) و کارگزار آن کشور محسوب خواهند شد. در این مقاله این موضوع که آیا ارتکاب اعمال شورشیان موجبات مسئولیت بین المللی دولت را فراهم می آورد و هم چنین معیارهای کنترل دولت مورد بررسی قرار خواهد گرفت. نتیجه گیری نویسندگان این است که چنانچه اعمال شورشیان به طور موثر توسط دولتی هدایت شوند قابلیت انتساب به آن دولت را خواهند داشت.

the attribution of the acts of the insurgents to the state

under the general rule, the conduct of the organized insurgents is not attributed to the state, because they are not the organs of the state and as such the state is not in a position to control effectively on their activities. but, there are situations that the conduct of the insurgents may be attributed to a country in whose territory they are acting or to the other country. the first case, is when the state is subject to cooperation charge or omission against the harmful actions of the insurgents. the second case, is while the insurgents act according to the direction or under the guidance or control of the other in this case, are de facto organ of that country. in this article, we discuss whether the conduct of insurgents may cause international responsibility of the state as well as the criteria of state’s control will be considered. the authors conclude that if the insurgents effectively conduct by a an state, their acts will be attributed to that state
