مطالعه تطبیقی جرایم سایبری در ایران و حقوق بین الملل

هرگونه تغییر و تحول در دنیای کنونی، خواه ناخواه آثار و پیامدهایی به همراه خواهد داشت. به گونه ای که با اختراع وسیله ای جدید همواره امکان سوء استفاده از آن ها وجود دارد. در این راستا علم حقوق هر آن چه را که کوچک ترین خدشه ای به این توازن وارد نماید، تحت پوشش قرار داده و سعی در رفع یا پیشگیری از آثار نامطلوب می نماید. فضای سایبر نیز از این قاعده مستثنی نبوده و آثاری بصورت مثبت و منفی در زندگی بشر وارد نموده است که ضرورت مطالعه آن را انکارناپذیر می نمایاند. متعاقب این کار با این امر سیاستگذاران جنایی، حقوقدانان و جرم شناسان به این فضا ورود پیدا کرده و با تعریف جرایم سایبری، پیش بینی مجازات های متناسب با آن و ارائه و انجام تدابیر امنیتی و پیشگیرانه نسبت به مخاطرات این فضا و آموزش و آگاه سازی افراد از پیامدهای مخرب فضای سایبر، وظایف اساسی خود را در این زمینه انجام می دهند که بررسی کیفیت و ابعاد این کارکرد امری ضروری است. در این مقاله ماهیت فضای سایبر و ابزارهای ارتباطی، تعریف، تاریخچه، ویژگی و طبقه بندی آن مورد بررسی قرار می گیرد. خطرات احتمالی و جهانی شدن مقابله با جرایم سایبری از نکاتی بود که به عنوان نتیجه بحث مطرح شد. همچنین پیشنهاداتی به عنوان مدل مورد استفاده برای سیاست گذاران جنایی کشور جهت مقابله و پیشگیری از جرایم سایبری ارائه شده که امید است مورد توجه حقوقدانان، جرم شناسان و کاربران عزیز قرار گیرد.

Comparative study of cyber-crime in Iran and international law

Because of human activities complexity, Willynilly any change in present world would have impacts and outcomes. In such a way that with invention of new device, besides its correct and legal usage there is always the possibility of its misusing. In this regard, law science as a justice support and procreator of harmony in human society, would cover whatever which has a little blemish to this harmony and would try to remove or prevent it’s bad effects.Cyber context which caused by scientific and industrial advancements in recent century is not exempted from this and has entered negative and positive effects in human life which makes it’s necessity of study unavoidable. Hereupon, criminal politicians, jurists and criminologists have entered to this context and with definition of cyber crimes, prediction of it’s corresponded punishments and doing security and precautionary plans toward the dangers of this context, training and advertising people about destructive outcomes of cyber context do their main duties in this ground, which study on quality and dimension of this function is necessary. This study aimed at investigate the nature of cyber context and communication instruments, definition, history, characteristics and its classification. Possible dangers and globalization of contrast with cyber crimes were points which discussed as results. Also, it was given suggestions as mode used for criminal politicians of Iran to contrast and prevent cyber crimes which is expected be regarded by jurists, criminologists and users.
