مطالعه تطبیقی سرقت علمی در حقوق ایران و اتحادیه اروپا

کسب مدارج علمی و همچنین دستیابی به موقعیت های اجتماعی بالاتر، گاهی اوقات موجب بروز نوعی از رفتارهای غیر اخلاقی و نا به هنجاری می گردد که در عرف از آن به «سرقت علمی» یاد می شود؛ پدیده مذکور در اکثر جوامع مورد مذمت و نهی قرار گرفته است اما این مقابله با شدت و ضعفی همراه بوده است. در پژوهش حاضر با استفاده از روش توصیفی تحلیلی، بررسی خواهد شد که فرهنگ جوامع چه میزان تاثیری بر میزان سرقت علمی و مقابله با آن دارد؟ و اینکه در قوانین موضوعه کشور ایران و کشورهای عضو اتحادیه اروپا چه راهکارهایی جهت مقابله با پدیده شوم «سرقت علمی» در نظر گرفته شده است؟ نتایج بدست آمده حکایت از آن دارد که فرهنگ هر جامعه تاثیر به سزایی در میزان سرقت علمی اشخاص آن جامعه دارد و در کشورهای عضو اتحادیه اروپا گذشته از وضع قوانین، تاکید فراوانی بر اعمال سیاست های آموزشی در راستای القای فرهنگ پژوهشی مناسب و کارآمد به جامعه شده است، اگرچه در حقوق ایران نیز قوانین متعددی از جمله قانون عام «حمایت حقوق مولفان، مصنفان و هنرمندان» در سال 1348و همچنین قانون نسبتاً خاص «پیشگیری و مقابله با تقلب در تهیه آثار علمی» در سال 1396 به تصویب رسیده اند که ضرورت دارد به صورت کارآمدتری اجرا گردند. معضل اساسی در این راستا ناشی از اعطای ارزش کاذب اجتماعی به مدارج علمی در جامعه می باشد که برخی اوقات منجر به نقض اصول فرهنگی و نادیده گرفتن ابعاد مادی و معنوی حق مولف می گردد.

A Comparative Study of Scientific Theft in Iranian Laws and European Union Member States

Acquiring scientific degrees as well as accessing higher social positions can sometimes lead to a kind of unethical and abnormal behavior that is commonly referred to as scientific theft in most societies denounced But this confrontation has been accompanied by weaknesses. In the present study, using a descriptiveanalytic method, we will examine how the impact of societal culture on and against the theft of scientific theft? And what are some of the ways in which the laws of the country of Iran and the EU member states deal with the ominous phenomenon of scientific theft? The results show that the culture of each society has a significant impact on the level of scientific theft of its members, and in the EU member states, in addition to the laws, there is a strong emphasis on the implementation of educational policies to instill a proper and efficient research culture in society. However, several laws have been enacted in Iranian law, including the Comprehensive Law on the Protection of Authors, Authors and Artists, Adopted in 1348, as well as the relatively specialized Law on Preventing and Combating Fraud in the Making of Academic Works, Adopted in 1986. They need to be run more efficiently. Another major problem in this regard is the violation of cultural principles, the disregard of the intellectual property rights of the copyright holders on the one hand, and the attainment of scientific degrees without direct and genuine research by some individuals resulting from the granting
