تحلیل حقوقی - جرم‌شناختی تشهیر متهم و کارکردهای انتظامی آن

زمینه و هدف: قانون‌گذار در مواد مختلفی از قانون مجازات اسلامی و قانون آیین دادرسی کیفری، انتشار احکام قطعی محکومان و انتشار تصویر و اطلاعات هویتی متهمان را مورد توجه قرار داده است. درواقع، تشهیر محکومان و متهمان موضوعی است که در نظام حقوقی ایران پذیرفته شده است. پیش‌بینی چنین اقدامی، با وجود انتقاداتی که بر مبنای نظریات جرم‌شناختی نظیر نظریۀ برچسب‌زنی و همچنین ایرادات و چالش‌های کیفرشناختی و حقوق بشری که بر آن وارد است؛ در بسیاری از کشورها رایج بوده و به‌عنوان ابزاری در حفظ نظم عمومی و مصالح اجتماعی، اعاده حقوق بزه‌دیدگان و بازدارندگی عمومی، مورداستفاده قرار می‌گیرد. هدف این پژوهش، تحلیل حقوقی و جرم‌شناختی تشهیر متهم (از طریق نشر تصاویر) و احصاء کارکردهای انتظامی آن بود.روش: پژوهش حاضر به روش توصیفی تحلیلی با استفاده از منابع اسنادی کتابخانه‌ای انجام شده است.یافته‌ها: نشر تصاویر متهم به‌عنوان مصداقی از تشهیر قانونی، شیوه‌ای متداول برای پیشبرد اهداف عدالت کیفری در بسیاری از کشورها است؛ اما در نظام کیفری ایران اصل بر ممنوعیت نشر تصاویر متهم بوده و برای اولین بار مصادیق استثنایی جواز نشر تصاویر متهم در ماده 96 قانون آیین دادرسی کیفری مصوب 1392 پیش‌بینی شد. مقنن در این ماده، ضمن تاکید بر ممنوعیت نشر تصاویر متهم، در بندهای «الف» و «ب»، مصادیق نشر تصاویر متهم و شرایط آن را مورد تصریح قرار داده است.نتیجه‌گیری: از منظر بسیاری از نظریات جرم‌شناختی، تشهیر متهم رفتاری نکوهش شده است که می‌تواند تبعات متعددی داشته باشد. بااین‌حال، تشهیر متهم به روش‌های یادشده، کارکردهای انتظامی دارد و در راستای برقراری نظم، می‌تواند به پلیس کمک کند. بازدارندگی عام و خاص، عبرت عمومی و فردی، مشارکت مردم در اقدامات انتظامی، شناسایی و دستگیری متهمین فراری و کشف حقیقت و همچنین اطلاع‌رسانی به بزه‌دیدگانی جهت تعقیب، ازجمله مهم‌ترین کارکردهای انتظامی تشهیر متهمین هستند که پلیس را در رسیدن به اهداف خود یاری می­کند.

legal-criminological analysis of the public shaming of suspects and its police functions

background and objective: the legislature has addressed the publication of final judgments of convicts and the dissemination of images and personal information of suspects in various provisions of the islamic penal code and the code of criminal procedure. in fact, the public shaming of convicts and suspects is a practice accepted in iran’s legal system. despite criticisms based on criminological theories such as labeling theory and legal and human rights objections, this practice is common in many countries and is used as a tool for maintaining public order, and social interests, restoring victims’ rights, and general deterrence. this study aimed to analyze the legal and criminological aspects of public shaming of suspects (through image publication) and to enumerate its police functions.method: the present study was conducted using a descriptive-analytical method with library-documentary resources.findings: publishing images of suspects as a form of legal public shaming is a common method for advancing criminal justice goals in many countries. however, in iran’s criminal justice system, the principle is against publishing suspects’ images. for the first time, exceptions allowing the publication of suspects’ images were stipulated in article 96 of the code of criminal procedure, enacted in 2013. the legislature emphasized the prohibition of publishing suspects’ images while specifying exceptions and conditions in paragraphs &a& and &b&.results: from the perspective of many criminological theories, public shaming of suspects is a reprehensible behavior that can have multiple consequences. nevertheless, public shaming of suspects through these methods has police functions and can assist the police in maintaining order. general and specific deterrence, public and individual admonition, public participation in police actions, identification and arrest of fugitive suspects, discovery of truth, and informing victims for prosecution are among the most important police functions of public shaming that aid the police in achieving their objectives.
