بحران سیاست جنایی ایران در حوزه جرایم رایانه‌ای و راهکارهای پیشگیری از تشدید آن

زمینه و هدف: تغییر سبک زندگی جوامع در دهه‌های اخیر و گرایش اکثریت افراد جامعه ایران به فضای مجازی به عنوان محل دوم زندگی زمینه همگامی سیاست جنایی با این تغییر و تحوّلات و اتخاذ سیاست‌های نوین و کارآمد تقنینی و قضایی را ایجاد کرده است. سیاست جنایی ایران بایستی از این تحوّلات متاثّر گشته و در جهت ترسیم سیاست جنایی نوین در حوزه فضای مجازی قدم بردارد.روش: پژوهش حاضر از نظر هدف، کاربردی و از نظر نوع پژوهش، توصیفی-تحلیلی است که با استفاده از منابع کتابخانه‌ای مطالب جمع‌آوری و تحلیل شده‌اند. یافته ‎ها: تدقیق در سیاست ترسیم‌شده منتهی به نتیجه‌ای است که حکایت از انسداد و ناکارآمدی دارد. انسداد در تعقیب جرایم رایانه‌ای به لحاظ تورّم کیفری، قواعد ناکارآمد صلاحیت، ابهام در مفهوم جرایم مشهود رایانه‌ای، خلا هنجاری و ناکارآمدی ادله الکترونیکی جلوه‌های بحران در سیاست جنایی ایران در زمینه جرایم رایانه‌ای هستند که متاثّر از تفکّرات، رویکردها و سیاست‌های سنّتی در قبال پدیده‌های نوظهور به وجود آمده‌اند.نتایج: راه‌حل پیشگیری از تشدید بحران موجود، ترسیم و اعمال سیاست جنایی تلفیقی، افتراقی و تعامل‌گرا در حوزه تقنین و اصلاح مقررات در پرتو سیاست‌های مذکور است.

field and aims: the change in the lifestyle of the societies in recent decades and the tendency of the majority of people in the iranian society to virtual space as a second place of life has created the context for the synchronization of criminal policy with this change and evolution and the adoption of new and efficient legislative and judicial policies. iran’s criminal policy should be affected by these developments and take steps towards drawing a new criminal policy in the field of cyber space.method: the current research is applied in terms of purpose and descriptive-analytical in terms of the type of research, which has been collected and analyzed using library sources.findings: scrutiny in the drawn policy leads to a result that indicates blockage and inefficiency. obstruction in prosecuting computer crimes in terms of criminal inflation, ineffective rules of jurisdiction, ambiguity in the concept of apparent computer crimes, normative vacuum and ineffectiveness of electronic evidence are the manifestations of the crisis in iran’s criminal policy in the field of computer crimes, which are influenced by traditional thoughts, approaches and policies towards the phenomena. have emerged.conclusion: the solution to prevent the aggravation of the existing crisis is to draw and implement a unified, differential and interactive criminal policy in the field of legislation and amending regulations in the light of the aforementioned policies.
