راهکارهای پیشگیری از جرایم زیست محیطی با تاکید بر پدیده اکوساید

زمینه و هدف: امروزه یکی از مشکلات بشر، فاجعه برهم خوردن تعادل زیست‌محیطی است که زیست‌بوم کشی، طبیعت کشی، جنایت علیه محیط زیست یا اکوساید به هر نوع خسارت رسانی و تخریب گسترده‌ی چشم‌اندازهای طبیعی و ایجاد اختلال یا نابودی اکوسیستم(های) یک منطقه گفته می‌شود به گونه‌ای که ادامه‌ی زیست گونه‌های موجود در آن اکوسیسم(ها) به مخاطره بیفتد که این پژوهش به ارائه پاسخ‌های پیشگیرانه کیفری و غیرکیفری پرداخته است.روش: پژوهش حاضر به روش توصیفی و تحلیلی انجام شده است. یافته‌ها: جرم‌شناسی سبز، جرم‌شناسی فرهنگی سبز، جرم‌شناسی جهان بوم و جرم‌شناسی تغییر اقلیم مهم‌ترین مبانی جرم‌شناختی پیشگیری از جرایم زیست محیطی تلقی می‌شوند و هم چنین اصول حاکم بر پیشگیری از جرایم زیست‌محیطی (اکوساید) شامل اصل احتیاط و پیش‌بینی جرایم زیست‌محیطی، اصل جهانی شده پیشگیری زیست‌محیطی، اصل ضرر نرسانی و پیشگیری از جرایم زیست‌محیطی و اصل مشارکت در پیشگیری از جرایم زیست‌محیطی می شوند. نتایج: نتایج تحقیق حاکی از آن است که راهکارهای پیشگیری از جرایم زیست‌محیطی با تاکید بر پدیده اکوساید در دو محور پیشگیری کیفری در قالب شناسایی اکوساید به عنوان جرم بین‌المللی علیه صلح و پذیرش مسئولیت کیفری برای دولت‌ها در قبال جرم اکوساید امکان‌پذیر است و پیشگیری غیرکیفری با دو رویکرد پیشگیری وضعی از طریق شناسایی مسئله به مثابۀ راهکار عملیاتی و به‌کارگیری فناوری‌های نوین و هم‌چنین پیشگیری اجتماعی از طریق نقش و جایگاه سازمان‌های غیردولتی، پیشگیری آموزش محور و نقش رسانه‌های گروهی قابل ارائه است.

providing solutions to prevent environmental crimes with an emphasis on the phenomenon of ecocide

field and aims: today, one of the problems of mankind is the catastrophe of disrupting the ecological balance, which is bioecology, nature killing, crime against the environment, or ecocide to any kind of extensive damage and destruction of natural landscapes and disruption or destruction of the ecosystem(s) of a region. it is said in such a way that the continuation of the existing species in that ecosystem(s) is endangered, this article seeks to identify criminal and non-criminal preventive responses to the phenomenon.method: the present research is done in a descriptive and analytical way.findings: green criminology, green cultural criminology, global criminology, and climate change criminology are considered the most important criminological foundations of environmental crime prevention. and the principles governing the prevention of environmental crimes (ecocide) include the principle of caution and prediction of environmental crimes, the globalized principle of environmental prevention, the principle of doing no harm and the prevention of environmental crimes, and the principle of participation in the prevention of environmental crimes.conclusion: the results of the research indicate that the solutions for the prevention of environmental crimes are possible by emphasizing the phenomenon of ecocide in the two axes of criminal prevention in the form of identifying ecocide as an international crime against peace and accepting criminal responsibility for governments for the crime of ecocide and non-criminal prevention can be presented with two approaches of situational prevention through problem identification as an operational solution and the use of new technologies, as well as social prevention through the role and position of non-governmental organizations, education-based prevention and the role of mass media.
