مبانی و بسترهای قانونی ارزیابی تاثیر جرم شناختی پروژه‌های اقتصادی در ایران

زمینه و هدف: پروژه‌های اقتصادی به‌ فراخور مقیاس و ویژگی‌هایشان می‌توانند آثار بسزایی بر نرخ جرم در جوامع تحت تاثیر باقی بگذارند. درحالی‌که امروزه انجام انواع ارزیابی تاثیر زیست‌محیطی و اجتماعی برای انواعی از اقدامات توسعه‌ای ضروری تلقی می‌گردند، پیامدهای مرتبط با جرم این پروژه‌ها مغفول واقع شده‌اند. این پژوهش درصدد بازشناسی اهمیت و ضرورت ارزیابی تاثیر جرم‌شناختی پروژه‌های اقتصادی در بستر مبانی نظری و منابع قانونی و جایگاه پلیس در این حوزه است.روش: پژوهش حاضر با روش توصیفی - تحلیلی انجام ‌شده است.یافته‌ها: پیچیدگی مباحث مرتبط با جرم، در کنار حقوقی اساسی بشر و همچنین الگوی توسعه‌ی پایدار و مولفه‌های حکمرانی مطلوب، ارزیابی تاثیر جرم‌شناختی پروژه‌های اقتصادی را به‌عنوان حوزه‌ای مستقل ضروری می‌سازد. برای اجرای این قسم از ارزیابی می‌توان به فحوای موادی از قوانین برنامه‌های توسعه کشور ازجمله مواد 57 و 80 برنامه‌ی ششم توسعه و ماده 6 قانون پیشگیری از جرم استناد نمود.نتایج: در حال حاضر با ابتنای بر ظرفیت‌های موجود می‌توان به اجرای ارزیابی تاثیر جرم‌شناختی پروژه‌های اقتصادی پرداخت. در فرایند اجرای گام‌های اساسی ارزیابی، پلیس جامعه‌محور به سبب ارتباط و اعتماد دوسویه مردم و دولت نقش حیاتی ایفا خواهد نمود. ارزیابی تاثیر به افزایش محبوبیت پلیس، افزایش اعتماد متقابل دولت و جامعه محلی، تحقق جامعه‌ای مسئولیت‌پذیر کمک می‌کند و نظام‌های برنامه‌ریزی را از رویکردهای درمان گرا به پیشگیری محور سوق می‌دهد.

theoretical foundations and legal frameworks for evaluating the criminological impact of economic projects in iran

field and aims: depending on their scale and characteristics, economic projects can leave a significant impact on the rate of crime in the affected communities. while today, environmental and social impact assessments are considered as a necessity for various development actions, the criminal consequences of these projects have been neglected. this research seeks to recognize the importance of criminological impactassessmnet of economic projects in the context of theoretical foundations and legal sources and the position of the police in this field.method: this research was carried out in terms of practical purpose. in terms of collecting information, it was done in a library method and analyzed in a descriptive-analytical way.findings: the complexity of issues related to crime and possible damages, along with basic human rights, as well as the model of sustainable development and the components of good governance, make it necessary to assessment the criminal impact of economic projects as an independent field. to implement this type of assessment, we can refer to the provisions of the laws of the country’s development program and crime prevention law.conclusion: we can implement this task with the existing capacities. in the process of implementing the criminological impact assessment, the community-oriented police will play a vital role . impact assessment helps to increase the popularity of the police, increase the mutual trust of the government and the local community and move planning systems from treatment-oriented approaches to prevention-oriented ones.
