واکاوی جامعه‌شناختی پیامدهای گرایش به سگ‌گردانی در سنجه جرم‌شناسی با تاکید بر نقش پلیس در برخورد با این پدیده

زمینه و هدف: در حال حاضر موضوع نگهداری از سگ به‌عنوان حیوان خانگی به رویه عمومی گسترده‌ای در جامعه تبدیل‌شده است و گواه بحرانی شدن اوضاع اجتماعی و تغییر فرهنگ و سبک زندگی ایرانی- اسلامی و تمایزجویی اجتماعی است؛ چرا که در فرهنگ ایرانی- اسلامی، زندگی با حیوانات یکی از امور نامتعارف جامعه محسوب می‌شود که از نظر اسلام نیز مورد نکوهش قرار دارد. از این‌رو نوشتار حاضر درصدد است تا راهکارهایی را به‌منظور رفع نارسایی‌های نظام کیفری ملی ارائه نماید.روش: پژوهش حاضر از نظر هدف، کاربردی و از نظر نوع پژوهش، توصیفی- تحلیلی است که با استفاده از منابع کتابخانه‌ای، مطالب آن جمع‌آوری ‌شده است.یافته‌ها: یافته‌ها نشان می‌دهد پدیده سگ‌گردانی تاکنون باعث بروز مشکلات متعددی از قبیل دلهره، اضطراب، هراس و ترس؛ سلب آسایش و آرامش روانی همسایگان به‌ویژه در محیط‌های آپارتمانی و بروز نزاع و درگیری بین مردم؛ تحمیل هزینه‌های سنگین خرید، مراقبت و نگهداری حیوانات یاد شده بر اقتصاد جامعه و خانواده‌ها؛ آلوده‌سازی، نجس کردن و ایجاد مشکلات بهداشتی در اماکن و معابر عمومی؛ تسری، انتقال و فراگیری بیماری‌های فراوان مشترک بین انسان و حیوان و تغییر تدریجی سبک زندگی ایرانی اسلامی و جایگزینی احساسات و روابط عاطفی با حیوان به‌جای روابط انسانی و خانوادگی شده است.نتیجه‌گیری: در قوانین کشور جرمی به‌عنوان سگ‌گردانی تعیین نشده است. با نگاهی به قوانین و مقررات موضوعه نیز می‌توان خلا قانونی درباره این پدیده را تصدیق کرد. از این‌رو راهکارهایی در مواجهه با حیوانات مضر و خطرناک و صیانت از حقوق عامه در قالب الحاق چهار ماده‌ واحده؛ به‌عنوان ماده (688 مکرر1)، (688 مکرر2)، (688 مکرر3) و (688 مکرر4) به قانون مجازات اسلامی (کتاب پنجم- تعزیرات)، ارائه می‌شود.

Sociological analysis of the consequences of the tendency to keep pets with emphasis on the phenomenon of canine disturbance in the criminological scale

Method: The present study is applied in terms of purpose and descriptive-analytical in terms of the type of research, the contents of which were collected using library resources.Findings and Results: The findings show that the phenomenon of canine disturbance has caused many problems such as panic, anxiety, panic and fear; Deprivation of comfort and peace of mind of neighbors, especially in apartment environments and the occurrence of quarrels and conflicts between people; Imposing heavy costs on the purchase, care and maintenance of these animals on the economy of society and families; Pollution, impurity and health problems in public places and passages; The spread, transmission and spread of many common diseases between humans and animals and the gradual change of Iranian-Islamic lifestyle and the replacement of feelings and emotional relationships with animals instead of human and family relationships. The law of the country does not criminalize misdemeanors. A legal vacuum on this phenomenon can be confirmed by looking at the relevant laws and regulations. This article seeks to address the shortcomings of the national penal system and the inclusion of articles in the Islamic Penal Code (Book 5 of the Penal Code) in the face of harmful and dangerous animals and the protection of public rights in the form of the inclusion of four single articles as follows As an article (688 frequent 1), (688 frequent 2), (688 frequent 3) and (688 frequent 4) to the Islamic Penal Code (Book 5 - Punishments).
