شاخصه‌های کرامت انسانی در نظام اسلامی

اصل کرامت انسانی مهم‌ترین اصل مبنایی و پایه‌گذار نظام بین‌المللی حقوق بشر است که حق‌های بشریِ شناسایی‌شده در نظام بین‌المللی حقوق بشر براساس آن توجیه‌پذیر است. این اصل، در اسناد حقوق بشری بین‌المللی و منطقه‌ای متعددی شناسایی شده است و حتی در اسناد مربوط به حقوق بشردوستانه نیز بر رعایت این اصل و لزوم احترام به آن تاکید شده است. یکی از مقولات بنیادین در اندیشه معاصر، کرامت انسان است. نوشتار حاضر پس از اشاره‌ای گذرا به مفهوم کرامت انسانی و تامل در مبانی آن در اندیشه اسلامی، می‌کوشد با استناد به آیات و روایات به نتایج و لوازم و مقتضیات آن در نظام اسلامی اشاره کند. یکی از وظایف مهم نظام اسلامی، ایجاد بستر مناسب برای بهره‌مندی انسان‌ها از همه ظرفیت‌های مادی و معنوی‌ است که خداوند برای تامین سعادت و تعالی آنان در وجود انسان و جهان آفرینش قرار داده‌ است. نمودِ ظاهری نظام اسلامی را می‌توان در حاکمیت ارزش‌های دینی و سبک زندگی اسلامی مبتنی‌بر اعتقادات و دستورات اسلامی برگرفته از قرآن و سنّت مشاهده کرد که در آن شهروندان جامعه اسلامی حق حیات طیبه، امنیت، آزادی‌های اجتماعی، رشد عقلانیت و دوری از جهل و خرافات، بهداشت جسمی و روحی، استقرار عدالت، گسترش اخلاق و فضایل انسانی و رعایت شان و حرمت انسانی در پرتو مردم‌سالاری دینی دارند. البته کرامت انسانی، مطلق نیست بلکه نسبی و تشکیکی است و براثر رفتارهای اختیاری ناشایست و سوء‌استفاده از استعدادها و فرصت‌های موجود، قابل سلب است و همین امر مجوز مشروعیت برخی مجازات‌های به ظاهر تحقیرکننده یا دردناک و متناسب با جرم ارتکابی است.
