بررسی چالش‌های حقوق کیفری در جرائم مواد مخدر در ایران

هدف پژوهش تعیین قلمرو حقوق کیفری است. سطح مجاز مداخلۀ حقوق جزا به‌عنوان شدیدترین نوع مداخله در حقوق و آزادی های شهروندان با پیچیدگی ها و دشواری‌های متعددی مواجه است. اصل حداقل بودن حقوق جزا به‌عنوان یکی از اصول بنیادین این دانش، فن و ابزار کنترل اجتماعی با تاکید بر آثار سوء‌مصرف مفاهیم، ابزارها و نهادهای حقوق کیفری در تلاش است تا قلمرو مجاز حقوق کیفری را تعیین نماید، روش پژوهش حاضر توصیفی و تحلیلی و ابزار گردآوری اطلاعات کتابخانه ای و به صورت فیش برداری است. پژوهش حاضر با توجه به سوال اصلی که مطرح می شود این است که رویکرد حقوق کیفری ایران در مبارزه با جرائم مواد مخدر با چه چالش هایی مواجه است و این فرضیه را می توان مطرح کرد که هزینه بردار بودن، گستردگی فراوانی جرائم، عدم تطابق جرم با مجازات و عدم دستیابی به بازده مناسب از مهم‌ترین چالش‌های ورود حقوق کیفری در جرائم مرتبط با مواد مخدر است.

the impact of social security on prevention of social harms: a sociological analysis

what is a risk factor for security and one of the significant threats in this category is the prevalence of social harms in society. in the present paper, the importance, role and impact of social security as an important sociological category on social harms, which is one of the important components of deviance and crime, has been studied. the aims of the present article, while examining the conceptual literature of sociology of security and social harms, are to analyze and critique these two components and to express the inverse relationship between them as the dialectical relationship. the research method is written by reviewing study texts and collecting materials. in some books and articles, hirsch’s social control and agnio’s social pressure have been carried out using a theoretical model designed by researchers and sociological theories. after analyzing and explaining the concepts of social security and social harms based on sociological perspectives, conceptual literature and using the theoretical model, it was concluded that there is an inverse relationship between the two titles
